How long do we wait? Septic problems

We moved into a rental home in OH in November 2012. One week later, the tub stopped draining & toilet overflowed. After plunging the toilet, it did empty; but backed up into the tub. Yuck. After 2 days of this, the landlord had the septic tank emptied. 

Over 2 weeks ago, it started happening again. Called the LL on a Monday at noon. Did not hear back from him until 9pm that night. His plumber came the next morning to0 check it out. Said that the septic tank was plugged & full again. No way it can be full after 4 months with only 2 people living in the house.  He managed to unplug it. Plumber told me to call LL ASAP if we heard water gurgling anywhere. 2 days ago, the toilet was gurgling while the shower was running. This gurgling sound is made when the water from the shower backs up into the toilet. Then toilet overflowed; plunging forced waste water back into the tub. It does sometimes drain eventually….like after several hours.

Left LL a message, called & spoke to him later. Called again yesterday. Septic tank has been located & dug up. Also called to get an estimate on emptying the tank; our lease states that we pay for repairs less than $100. Looking at ~$250 to empty tank & dispose of waste.

Given that this has been an issue for 4+ months, & he hasn’t done anything in the last 2+ weeks, does this void my lease? We only have the one bathroom & this is getting ridiculous.
