Late Claim

The rental agency has not paid our security deposit back and it is now 31 days past our vacate date. They will be making a claim for water damage and cleaning but we have not rc’d that claim. The agreement states " ..the landlord shall have 30 days to give the TENANT written notice by certified mail to the TENANT last known mailing address of his intention to impose a claim on the deposit…" Are they still able to make the claim and deduct our security deposit?
