Latex painted bathtubs

By Joshua

After paying a deposit for an apartment my girlfriend and I found out that they paint the bathtubs with a latex based paint. She is allergic to latex. We have asked the complex in question if they could use a paint that didn’t have latex in it ( they said no because once you use something other than a latex paint you can’t go back). We asked if they could replace the tub itself. They said they could but it would be at our expense. Can they do this? This is a medical issue a common enough allergy that I think they would have to disclose that they paint the tubs with a latex based paint. They did not do so we only found out from a friend who used to live there. I want to know what our options are, we live in Indiana. Can they make us pay for a new tub? Can they keep our deposit if we decide we can’t live there?
