renter with no contract

we are renters in indiana, but we are under no contract. my husband started my signing a land contract with the landlord in january of 2006. the contract was up in january of 2009, and now she is forcing us to sign a new contract to pay more money a month. my question to u is, we havent paid the rent payment yet this month and she sent us a 30 day eviction notice thru the mail that she typed up, then we received a court hearing to go to court because she is filing for imediate posession. is she able to receive immediate possesion if we are under no contract plus we have 3 little kids living with us? please try to help me understand. do we get a grace period to move out?

It veay’s state to state in fl you get a chance to tell the judge your side I.E why you didn’t pay rent but make sure that you put your answers to the court in writing and make sure you give them any and all evidence that you have .
