Unreported Damages Fee for Reported Damages

Hi, I’m renting a house with some fraternity brothers. It’s my junior year of college, and everything had been fine. Now there is one month left on our lease and my landlords are charging us a fee for unreported damage to the wall.

The damage was caused by a new furnace they put in before winter, and is not our fault at all. Basically, the furnace was heating an old chimney in the building and some nasty stuff (cresote or something they called it, maybe?) was leaking down the chimney and on the walls.

It was after returning from winter break when I first noticed this nasty brown goo running down the wall in my bedroom, so I made a work order via there website. A couple weeks past, no one came. So I made a new work order via a tenant portal thing that they use for rent payments.

Two weeks later, they came and looked at it, and then proceeded to do nothing about it until about a month ago (because now they need to lease the house to someone else next year and have a hard time doing that with nasty brown stains running down walls). So they came and finally fixed it, 3-4 months after I reported it.

You can guess what happened next, they are charging us all fees for unreported wall damages that they had to fix. I feel like they are just trying to screw us over. I have documentation of the second report I made, but since the first one was by their website I don’t have any doscumentation of that besides that the second report refers to the first one.

Please help!!!
