my daughter is finishing her doctorate in San Antonio and is living in an apartment with her significant other.  She is 5 months pregnant and the apartment is extremely small.  Would the expectation of a baby in the apartment and the fact that they need a place to put the baby, not reason to break their lease? The lease is up the month she is due and moving is a hardship at the stage of her pregnancy. Any advice? They have tried speaking with the office personal and they refuse to cooperate.

Hi Cyndy! Your daughter can break her lease she just needs to inform her landlord with a 30-days written notice to vacate the property and send it via certified mail. If her landlord will refuse her to vacate the rental unit she can file a complaint against him. Your daughter has two options. She can either hire a lawyer to represent her in court or she can file a complaint with a mediation company like the RPA. Whatever she choose she can get the resolution she needs. Good Luck!

there was a fire in my building and my apartment got smoke damage along with clothing a bed and carpets what is the landlord liable for

That depends on how the fire started. If it was from another tenants negligence, you might have to hold that person responsible. If it was foreseeable and the landlord didn’t take steps to fix a problem that caused the fire then the landlord might be responsible. Do you haven tenant insurance?

Kit is right. and if you have an insurance, you can take pictures of the damaged things and collect an insurance but the landlord would not be liable for damage of personal property if he does not have control over the incident. But if the fire is foreseeable like he neglected to make some repairs and it is the cause of fire, then, he is liable.

HI ~
We have been renting for several years and we got word our landlord hasn’t been paying his mortgage and is shortselling. We stopped paying rent and worked with him to ‘show’ the house to get it sold. The house – as far as I know is sold. There is a guy in Florida my Landlord worked with at a bank, I called him and confirmed the house is sold and he said we need to move out. He said ‘you should move now or within a few weeks?’ I said.. ‘We haven’t even been given a 30 day notice.’ A few days later this guy at the bank in Florida (I’m in California) called back and gave me a verbal 30 day notice????
WHO do I have to listen when getting a notice? I’m assuming it will need to come in writing by the bank or the new landlord??? What are my rights?

Please help!! Well since we moved in our new appartmemt me and my man befriended the neighbor ever since my boyfriend told her he no longer wanted to associate with her she slammed the door in his face and hassle our lives a living hell. She recently called CPs saying that my son was on danger because we argue all day everyday! That is not true now CPs has taken him and she continues to call the police for the past 4 times they have come and it’s falsely accusing us of fighting what can I do because the landlord won’t do anything

Every month I’m charged a monthly billing or processing fee just to pay my rent (by any means)? Basically, they are charging me $50 a year to pay them. It is in the lease, but that doesn’t make it legal? Is this really legal in Pennsylvania or anywhere?

 i’ve been compromising with my landlord but today he put me over the edge. I understand that all landlords care about is money money money. But seriously the landlord is picking on me ever since the first day i moved into the apt he’s been extra hard on me. He’s been nice up to the first month of rent. He complained about me leaving a couch in my parking space just for a day in-order for me to remove it, making a huge fuss about it. while other tenants throw chairs beds and couches in our garbage cans and i dont hear him say anything to them. Also my landlord didn’t fix anything in my apt when i moved in b/c i took over another girls lease and i was told that she was given  her full deposit. Which i dont think is right b/c the wear and tear should be charged on her not me when i move out b/c nothing was fixed when i moved in so to be safe i took pictures of everything that was wrong with the apt. Also our apt is old so we have an old style heater thats a gas heater which needs lighting. when i called my landlord he complained about coming to light our heater as well as when my roommate and i asked him to fixed the light in our fridge when it went out he never showed up. We barely ask our landlord to do anything for us and honestly i think its completely rude for him to complain when we do ask him to help us do something that he is suppose to. And today the thing that finally was the last draw he had my car towed!!!!. we are only given one parking spot and the other one we have to purchase a parking permit i misplaced my permit and so i parked a parking spot on our building. It has a sign that says if parked there cars would be towed but everyone in my apt uses it and keep their friends car or whoever’s car there in order to avoid a parking ticket. he’s seen so many cars park there and no one has ever been towed and just my luck he shows up at my apt and tows my car the one time i park there. and when i call him to ask him he yelled at me and said off course " can i not read" when he doesn’t tow anyone else but he does tow mines. This is ridiculous!!!!! l just spent the last 3 hrs on top $240 to get my car out of the impound lot.

i own a mobile home i lease land from the park when i had my grandson move in they told me he had to be on the rental agreement (land lease) he is 22 years old . he thinks because he is on the rental agreement i cant evict him. is he correct. after all its my home i just lease the land its on. he wont pay any rent

Hello,

Situation is this.  We moved in Oct 1st. On Oct. 8th another roommate posted an email on our door saying thes short sale buyer backed out and if landlord doesn’t find another buyer, house is foreclosing december 7th. And that was our 30 day notice unsigned, not dated.

The short sale buyer was a friend of the landlord and decided he couldn’t afford house.  However, we were told when we rented the short sale was a sure thing, tenants could stay — everything great.  At no time were we told that short sale is in lieu of foreclosure.  They say because it was "sure thing" that they had no obligation to tell us that it is in foreclosure because they had a buyer at the time. Now the new buyer is being difficult about letting us stay until the end of the month while we look for a place for our family of six.

Questions:seem

Is it legal for them not to tell a prospecitve renter about the house being in foreclosure wheather or not there is a short sale.? This seems very shady to me. 

They never mailed a notice that was signed and dated.  Do we have rights.? We are told to be out by the 11-10, we still have not found a place and we may need to stay untill the 30th. Why are they being so difficult.? We will pay the rent.  good grief!  The owners are not ending escrow until dec 10.

I’m out of work since January and not able to pay my rent the manager is telling me that to get out the contract that will be finih in October I have to pay $1500 my rent is $825.00 per month. I can’t find a job and I’m collecting unemplyment but is not enough. Can you tell me what can I do.
