Landlord is keeping deposit plus charging for extra cleaning fees

By Mike

I lived in a apartment, in Indiana, for over 7 years. When I moved out I left the apartment clean. Now the landlord is keeping my $575 deposit plus charging $130 for extra cleaning fees, because I was a smoker. There was never any clause in the lease, prohibiting me from smoking in the apartment. Additionally, in the 7 + years that I lived there, there were a few late rent payments(due to being laid off ) They never billed me, or asked for any late fees. Now that I’ve moved out, they claim that I owe them these fees. Can they do this?? Any help would be greatly appreciated.
