breaking lease due to sewer leaking

hi, i live in california and its a house that is split into a duplex. my  husband and i noticed a sewer leak in our laundry room and reported it. our land lord had put off fixing it due to his money situation and its been over a month. we just found out that our upstairs neighbor is dying from hepatitis and he is still refusing to fix it. we also had their dishwasher overflow and destroy our ceiling tiles, he cut pieces of drywall and brought those over which wont even fit.  i want to know if this is grounds to break the lease. thank you for your help.
