can my landlord evict in less then 1 month with no lease agreement?

we are currently renting a house and have been for the past 4 1/2 years. we’ve been signing just a year to year lease and when it was up in may 2010 we never received a new one. so we’ve been paying month to month since then. we have been having financial trouble for the past couple of months and have been paying week to week per a verbal agreement with the landlord. we were 100.00 short last week and the landlord is now saying we have to add that onto our next weeks payment or we have to be out by the end of the month(january). we were just notiified of that today 03jan. can they do that legally?
