Can my property management company do this?

By Anita

I have been in my house for 5 months and the property management place wants to evict me because my rent is 15 days late.

I am prepared to pay the rent with the late fee of 50 dollars but he refuse to accept it w/out the eviction fee.  I refused to pay a 500.00 dollar eviction fee when no eviction has been filed.

yet.  Because I refuse to pay a fee for something that has not been filed he says he will now proceed with the eviction notice and he refuse to take the rent.

I have never heard of that.  What is the late fee for if you are going to refuse payment?  Can the property management company do that, refuse rent and the late fee?

Require that you pay an eviction fee when there are no eviction papers?  Pleae help..

15 days late for rent is a long time!  Yes, you can be charged for eviction cost.  Keep in mind, you are in breach of your legal contract.  If you fail to comply with the terms of your signed lease, then you are the one at fault and not management.  If you feel your rights are being violated, file a complaint.   Otherwise, pay up.
