former landlord suing for damages, can they do this?

By Trish Smithson

My former landlord is suing me for $9000 damages in my old townhouse.  I moved out of the townhouse 3 years ago when I broke up with boyfriend.  He continued to live in it for the last 3 years.  He missed a rent payment 2 months ago and split.  He supposedly caused $9000 damage to townhouse.  The owner is suing me for the damage.  Can they do this?  Thanks.

Why are you the one being sued? Are you the one who signed the leasing agreement?

If your name was still on the lease, then as far as I know, you are still liable. The landlord has the choice to either sue you, your ex, or both of you. Since your ex took off on him, he is probably taking the most likely avenue to recoup his loses by suing you. You in turn have the right to sue your ex if there is a judgement entered against you. You would just have to prove that you no longer lived there. However, if you did indeed get your name taken off of the lease when you moved out, you have nothing to worry about.
