How can I get my deposit back?

Hi  – we’ve rented a short term furnished apartment in DC over a period of less than 90 days last fall. We paid a deposit and the agent refuses to refund it despite confirming that apartment was left in good condition. He is not returning our calls or emails. We are currently on assignment abroad and will not return to US till 2014. Here are my questions:

1) Can deposits be charged to short term leases (less than 90 days for which tax was paid, i.e. as I would have in a hotel)?
2) How can I get my money back without taking a lawyer?
3) is there prescription? I.e can I go to small claims court when I return to the US in 2014?
