Is this legal? Signed a lease and 10 days before move in date, current tenant decided not to move.

I signed a lease for an apartment, with a move in date of July 7th. I found out through the cable company, on June 26th, that the current tenant is not moving out. The apartment complex did not call to notify me, and still hasn’t notified the other party on the lease. They’re telling me that the current tenant decided not to move out, and that since their lease still has a few months on it, they’re allowed to stay, and we’ll have to move into a different apartment. Is this legal? Do I have any options?
