Late Fees

I was late with rent this month I asked someone to make the payment they did not and spent a portion of the rent. I returned home from out of town and found a 5 day notice. I was on the last day to make payment on the notice of $865. I had 600 left from what the person did not take. I took that money order down to the office they were closed and the rent drop was lock off. I had to leave again for work out of town. I dropped in in the mail along with a letter stating I would pay the additional $265 the  next day. I then tried to set up an auto payment for the next month so this wouldnt happen again. I receive an email from the apartments saying my payment was returned by the bank. I contacted her back and said I didn’t mean for a payment to go thru this month it was suppose to be set up for next month. I was then told I now had to pay $75 and 30 more in late fees. I was told they would not accept my $875 ($740 for rent and then balance was late fees) if I didnt sign a promise to pay and then I would be evicted. I agreed because I didnt’ want to be evicted. They added $252 due on the 21st. I asked why it was so much they said I am being charged late fees of $10 a day for the late fees. Now it is at 298 and they said if I dont have it tomorrow plus an additional 10 they are sending me to the attorney for eviction. I asked to be given a couple of days I would be in on Friday and pay it as well as July’s rent that isn’t even due until Sunday. I am being evicted for lated fees that have accumlated in a week and a halfs time on late fees? Is that even allowed? I am never going to be able to catch up. My rent and the bulk of the late fees have been paid.

Late fees

Our rental company changed hands.  When the company changed, so did our due date for rent. It went from the 7th to the 4th. For whatever reason, we thought it was the 5th. So we paid on the 5th for 6 months before our rental company told us that we were late and that we owed 6 months in late fees of $55 a month for a total of $330. Aren’t they obligated to tell us within that first month that we were late? If they had, then of course we would not have kept paying late.  Are we now obligated to pay all of the fees?

It’s hard to believe they would charge you that much for being supposedly late ONE day each month. Did I read that right….they want to charge you a late fee for each of those months?? They should first of all be thankful for tenants who pay monthly as you did…be it one day “late.” I would ask to see their rules and regs that say exactly how late a tenant is on rent before such a hefty late fee can be charged at all. Consider getting a copy of your receipts and check for each payment and present this to the top person in that company. Check online to see who is the owner and go to that person with your case and documentation. Most places have a grace period and for a new owner to be so rigid is…well…you already know. They certainly erred by not telling you right away exactly when the new payment is due, especially when you made it ONE whole day late…OMG. There should be some kind of landlord/tenant rights documentation. Renters have rights, too. Find out what a late payment really means…one day? Ridiculous. Always go to the top person….and if that means writing to their corporate office, do so and send your documentation. You always paid on time before, right? Make that a point in your statement, as well. Good luck.

LATE FEES ?

if you have a late fee that has not been paid for being late one month, and the past four months that this has not been paid and the following FULL rent is paid on-time is it possible for the Landlord to charge you late fees for the past four months even though the rent has been paid on-time? i have 59.95 for 4 months extra in charges. The Landlord is taking the 59.95 from the previous four months not paid and saying each month therafter is late because a 59.95 balance carried to each month. He calls 3 times a day and showed up at my rental home looking for these bogus late charges, all i should owe is one late charge from 4 mos. ago MEMPHIS, TN Home Rental occupied 2 years 4 mos. still occupied by me.

All i can say is to get the details of those charges. Refer to your receipts to make sure. Then file a complaint with RPA if those are really bogus.


Late fees

 Can a landlord impose late fees on a late fee, if the late fee in the beginning was for late on rent. I paid the rent, but still owe the late fee.
