leaking ceiling, and mold

I notified my landlord about a month ago about the roof in my 14 month old daughters room leaking. He said that he will get it fixed by painting over it and adding a sealer. He has not done anything about it and we owe the landlord $200 dollors for rent. What can we do? I have also had plumbing issues with him and the cocking on the showertub is pealing away. I have been told to try to find a new place, that the landlord has 3 weeks to get this issue fixed and that he has to put us up in a hotel until he has fixed it because of the mold. The leak in the roof of my daughters room is about 1 12 to 2 feet in a curcle and sags about 3 inches. it is also slowly making it’s way to the fan and light in the roof. the color of it is dark brownblack in some areas and waterstained brown and tan in others, the roof is also starting to seperate from the wall about a centimeter in one area (about 5 inch long gash.)

please help?!

The fact that you are behind on your rent can leave you fewer options when demanding repairs. If you are $200 behind in rent, your landlord is working with you, so its best to work with your landlord to resolve this issue.

The discolor dark brown and black is most likely not mold at all. Probably just water stains. Even if it is mold, only a small percentage of mold is toxic. (less than 1%) I’m not sure who told you that if mold is discovered that your landlord is required to put you up in a hotel. That isn’t true. In most cases you will be entitled to rent abatement for the days that the unit was uninhabitable. (not required to pay rent for those days)

I know this sounds backwards, but if you really want the repair to be completed; you first need to bring your rent current. Even though your landlord can’t evict you over a repair request, he can evict you for non-payment of rent. I would think that your landlord would want to protect his property and fix the water leak regardless of your late rent situation. BUT, maybe in his mind he may not feel that it is a very big deal and may think that you have no right to make any request due to your rent being late.
