no refund of deposit for not moving in

we gave the landord a deposit on 19th of december to move in on january 17th but we said we were not moving in anymore on the 15th but they won’t give the deposit back is what there doing illegal?

The security deposit is also called a damage, pet or cleaning deposit so if you never moved in, then that deposit should have been returned to you. However, you would have to check your lease on what is says regarding the deposit. After all, once you signed that lease, it becomes a legal and binding agreement so what it says must be followed. If the lease agreement does not say anything about the security deposit then you can file a complaint against that landlord. RPA has a complaint form that you can use for that.
