No Repairs..just excuses

I moved in to my condo I am renting from a realtor in July 2010. I was leaving for vacation so signing the lease was a quick process. She kept saying the unit wasn’t ready for me to look at and she was going to have it cleaned and some things fixed up. When I returned from vacation and moved in, nothing was fixed. She told me to send her a list of what needed to be fixed. I sent her a list of at least 12-15 things that I found to be looked at or needed fixing. A few light bulbs were burned out, the sliding screen door didn’t move or shut all of the way, the toilet was constantly running, and the bathroom fan doesn’t turn on or work correctly. She said she would look over the list and have her "handyman" come fix some things.

Well it is now December and I have never seen this "handyman" and none of the issues have been fixed. Whenever I email or call her about an issue, she says if it is not completely broken, she is not wasting the money to fix it. The "association" is charging her fees due to the flood and she doesn’t have the money to waste on repairs. I had to tape my screen door shut because of the huge gaps in between the door and the frame, so bugs would not come in. She kept asking me what was wrong with the door and that it couldn’t be fixed. She uses my work schedule as an excuse for why things can’t be fixed because I am not here to let someone in. She has a key but doesn’t want to drive to the unit to let somebody in.

I have had several problems with my air conditioning and now my heat. It doesn’t read correctly and turns on nonstop  or not enough. Right now my hands are freezing because my bill was just $105 dollars for a 750 sq ft condo. She gets an attitude with me every time I ask about repairs and says she doesn’t understand what I don’t get about the seasons changing and why I"m so shocked by a high bill. She is constantly comparing my bills to hers and past tenants that lived here. I don’t care what she pays or what anyone else pays, I have never had to pay a bill that high. She won’t fix the unit or replace anything and I"m so frustrated.

I emailed her last week about the toilet because it is a lot worse now. She said she will see when someone can come out. They were supposed to come this week and never came..now she says maybe next week when he’s not busy. Not one thing in this condo has been fixed since I moved in. We never signed a document saying what needed to be fixed because I couldn’t come in here due to her "guy" cleaning the unit. So I had to wait until after I moved in to make a list.

While I was signing the lease, she was constantly telling me stories about her past tenants and everything they did wrong. She was basically threatening me and said I better not try anything because she knows a lot of good lawyers to back her up. I knew I should have walked out right then, but I couldn’t find anywhere else to leave. Every few weeks it is another issue that goes without being fixed. She pretty much has "won" because she won’t fix anything and now she scares me. I don’t know what to do or how to get things fixed. I’m not sure if these issues are considered "habitable" conditions in the condo.

She is responsible for keeping the rental unit up to code, ensuring that all building systems are in working order, safe and in good repair. When she fails in these responsibilities, you can give written notice to her asking that repairs be made within 14 days. If she does not make these repairs, you may have the option of suing or terminating your tenancy.
