Noisy upstairs neighbors

Hi I would like to get some advise and comments on how to deal with noisy and disrespectful neighbors, I live on the first floor of a two family property, and until 5 months ago I enjoyed a peaceful quite life. When the second floor was rented, the new tenants decided that it would be ok to start moving their belongings from 10:30 PM until 1:30 am for three days. Ok some people have difficult schedules and perhaps this was the only time available, I can relate to that, but the move started in the middle of the week, come the weekend, they left for the beach I think, and came back late at night, only to at that time start fixing the furniture around the house. Both units have tiled floors therefore I do not expect silence but at least respect after hours. From there on it was downhill, they have two bathrooms,one of them located above my living room, which had a water leak that came through the ceiling and into my apartment, they were asked to not use that bathroom, but did not listen, the result, well my home theater unit was damaged. Moving along, they were given access to a section a the backyard, but they did not like the arrangements so they asked for a new one, which the landlord agreed to, but what do you know, that was not good enough because when they have a party or BBQ their guest run around all over the house. In the summer months, when one of this BBQs was taking place they wanted to use the garden hose to get the numerous children wet, but the water connection was not working, so up to the second floor went the hose, hooked to the kitchen sink and out the window through the roof onto the front yard. Well I figured what the hell, as long as they stay in their side I do not care, but the area they were in got wet and muddy so here they come to use the assigned area of the first floor, and the front yard that I forgot to mention is off limits to both of us.I had to close my curtains on a beautiful sunny day, because outside of it overlooking my living room and kitchen, a table was set up for him and his guest to play dominos. While this is going on, the the rest of the guest were upstairs running around the house. This was all summer long. Going back to the house, the layout is very simple both bedrooms are above each other, and the living rooms in the opposite side of the house, now truth be told, my apartment is a lot better designed and has a bit more room, in part due to the fact that I only have one bathroom, that being said, they decided that it will be better for them to make the living room their bedroom and the master bedroom a living room. Now some of you might say "Dude is their apartment, they pay rent, what is your problem?", well it is simple, their living room is now above my bedroom, and any activity they have at nigh or late is bothersome, specially parties, and they do have parties. To all of this add stump walking across the house, children running and bouncing basketballs inside, loud conversations and extremely loud music. Steps have been taken to try to address this problem, specially after the pipes from the bathroom upstairs cracked again, and yes they did not stop using it, which caused the ceiling to collapse in my living room, we all sat down I explained to them my problems, the guy was somewhat understanding but the girl was a bit reluctant almost to the point of being angry. This did not help, if anything made it worst. One night the stereo was extremely loud and the bass was set on beyond max, I tried to knock on the door but got no answer, so I took a broom stick and hit the ceiling with it, but they turned the music even louder,the only option left, the cops, which help for 10 minutes after that, the music became louder and they started hitting the floor and walls with the furniture. I was forced to take my wife out of the house that night because she was afraid, the violent manner in which they were hitting the floor was unbelievable. The next day they came back home late and as soon as they got in they started slamming the furniture above our bedroom just out of spite. Now I spoke to the landlord after this incident, the landlord told me that day, that their lease will not be renewed and that they were asked to leave as soon as possible due to damages to the house, specifically the plumbing, they have several repairs and the final strike was when the plumber found baby wipes and bottle caps in the main pipe, of course they blamed me for the wipes, but I do not have kids. Now their lease does not end for another 6 months and they are making my life pure hell, I don’t know what to do anymore.

Well you wrote this in february, and now we are at the end of July, My advice would have been that if you really liked your apartment a lot or may be low on funds…..Just stick it out. I had some horrible upstairs neighbors which forced me to move because of the noise, I actually had very bad thoughts, but decided to move.

Hello, I have been living in a apartment unit for about 2 years now and I am contantly dealing with my noisy negibors. My roomate and I have consistantly have been putting up with there fighting and abuse to there child. After expressing to them about how nosiy they are, no changes have been made. We have numerously called the landlord, police, and child protective services. No one seems to care or do anything. Nothing has been done and even the neighbors in the neighborhood have heard them fighting and are very unhappy with these people. Also one of nosiy tenants are not even on the lease from what was mentioned by the landlord themselves.The police also mentioned that there have been restraining orders made against the tenant thats not on the lease and that he should not even be living there.No actions have been taken. What can I do legally to get them evicted??
