OMG An Unlawful Detainer After 20 Years!!!

I understand the concern of my management company.  They are acting on behalf of the owner of the home that we have been renting for over 20 years.  It seems that our world is currently challenged right now.  I lost my over $80K job in September of ’09.  Luckily, I am a CA state retiree whose pension is almost $960.00 a month.  My wife’s unemployment ran its course.  She received the maximum number of extensions authorized by Congress.  Our struggles began close to 8 months ago when we realized that our finances were going to be challenged.  Both my wife and I accelerated our efforts to seek employment.  My wife only recently was assigned a temporary job as an election ballot counter for the upcoming mid-terms.  I had applied as well, but when I informed the temp service that I needed Frida off to address a personal matter (the unlawful detainer – never told them exactly what it was) they informed me that the assignment is for Thursday, Friday, Saturday and Sunday.  This will be an all or nothing assignment.  Well, I had to turn down the assignment.  Actually I had no choice as the response to the unlawful detanier is due on Friday.

My two daughtes recently withdrew from college to find work to assst the household pay our rent.  We are only one and a half months behind with paying our rent.  I was absolutely surprised that the owener, after 20 years of steady payments would take this action.

Well, in spite of this, I am compelled to respond to the unlawful detainer.  I will go before the court on Friday and detail our tenure in our home.  I will also note that, yes, we have had a bit of a rough period the lat 5 months or so.  Our efforts to alleviate this situation is just a few weeks away. 

I will inform the court that we will pay this month’s rent along with the late fees from September.  On November 5, our November rent will be due and I will inform the court that we are optimistic to meet that challenge as well. 

I would welcome anyone’s thoughts on this matter as I refuse to let our tears overwhelm us in our household.  We will hold it together. We do know that the owner, by virtue of the unlawful detainer, wants us out of her home.  I will inform the court that it will be our intention to seek housing elsewhere.

What are your thoughts on this please?
