should I pay legal fee if the landlord drop the case?

Hi, I have a complicated situation. the landlord sued me mainly because of the following 2 reasons:
1) My daughter makes a lot of noises and running (walking fast) during the day time.
2) My parents (unauthorized occupant) come to visit me for less than 2 months.
After I talked with the attorney they hired, they dismissed the case.
I don’t want to pay the fee just because the quality of the apartment is really poor, the floor is very creaky even if you just walk on it.
and their policy doesn’t say that visitor can’t stay longer than 1 month, are there any clear rules about visiting?
But, they still charge me $350 legal fee saying I breached the lease. Should I pay this? what if I don’t?
