Smoker living below me – cannot open windows

I moved into an apartment complex in Culver City, California.  Manager was advised prior that i could not be around smoke.  The tenant below is a heavy smoker and cannot open my windows.

 What agency can I report the owner since they acknowledged the situation.  I have a 1 year lease.  I moved in August 1, 2010.  I would like them to move me into another unit at their expense.  I need to live in Culver City until my child finishes school in June, 2010. 

 Please let me know my rights.  thank you.
