What are landlord/tenant maintenance responsibilities?

If you check the state and local laws all over the United States you can find it written there the different responsibilities of a landlord and tenant to the rental unit/property and also the area around the rental unit/property.


Here is the list of the responsibilities of a landlord:

  • Offer Basic Living Requirements. This is the main responsibility of the landlord, to make sure that the unit/ property is fit for human habitation. It must have the basic requirement for habitation like water, electricity and heat. Also the unit must be clean and sanitary and is structurally safe.
  • Repairs. The landlord is required to maintain the apartment free of any kind of repairs. If so the tenant has the right to request for repairs to be made on the unit.  The tenant can do this through written requests.
  • Lease Agreement. State and local laws require a landlord to provide his tenants with a written agreement containing the lease agreement made before moving in.

Here is also the list of the responsibilities of a tenant:

  • Keep the unit clean and safe. The main responsibility of the tenant is to make sure that the rental unit is clean and sanitary during their stay.  The tenant is not responsible to pay for any normal wear and tear however the tenant is responsible to pay for any repairs for the damages they or their guests may have caused.
  • Comply with the Lease Agreement. A lease agreement is a binding agreement between a landlord and a tenant in which both have their responsibilities written and agreed upon.

Allow Access to the Unit. In order for the landlord to perform his responsibilities, the tenant must allow the landlord to have access to his rental unit for inspections and repairs if there are any as long as the landlord gave a notice beforehand.
