Extremely loud neighbors-landlord unhelpful

I have lived in a ground floor apartment for 3.5 years now with my 4 children; 1 of whom has Aspergers.  We have not had one complaint to date since moving in nor have I once complained on any tenants.  This past November, 2 adults and an 8 year old boy moved in above me.  I believe they have 1-2 more adults and another child living in the apartment (3 bedroom).  The 8 year old boy has emotional disabilities.  This has been shoved in my face the moment they moved in.  I am constantly being subjected to him jumping, stomping, banging, running, screaming bloody murder all hours that I am home. 
I have been keeping a journal with dates/times/noises that I hear and turning them into the management office weekly as they requested me to do.  We also live in MN.

I had to attend a mediation session but the parents of the problem child never even showed up even though they were home.  Whenever I am home to go to my vehicle, take out the trash, etc, they watch my every move.  They are chain smokers and their ash and cigarette butts are all over my patio.  They do not clean it up at all.

I had been working with the manager’s boss and after 1 full month, I have not heard a thing from them.  Since these noises are rarely past 10 PM, calling the police nonemergency line to report them is a joke-plus the police will flat out tell them that apt #_____ called to report a complaint.  This is another separate issue.

My question is that what are MY rights as a tenant of over 3 years?  Do I not have a right to enjoy ‘normal apartment noises’ and feel safe and secure in my own home? With the constant over the top noises and being watched each second I am outside, I feel very unsafe.

Do I have to subject my own children to this and why should I have to move when we’ve made a home in this apartment, have many friends who cannot BELIEVE what I have to live with and what is this teaching my own children?  We’re at the point we try and find reasons to NOT be home just to not have to deal with this riduculous lack of regard for anyone besides themselves.

You have the right to “peaceful enjoyment of your home.” Yes, apartment noises are common because you are living so close to each other. However, what you are going through is already uncommon. You have been reporting the issue to the landlord and has even made a journal about it and that’s very good documentation. I think, you’ve tried everything that you can do. At this point, I think it’s best to involve some professionals to mediate for you. The RPA has a complaint center that you can use. They negotiate with your landlord directly in order to address your problem fast. Good luck!
