Landlord Problems — GET OUT!…NO STAY!

By CYNDI

From the beginning our landlord has been deceptive; for example, when we rented we were told we had exclusive use of the backyard and small deck.  In addition, we were told that there was central air and heat.  When we attempted to access the backyard we were informed that he was "renovating it" and needed to wait.  We have not had access to the backyard to date.  He put in a trampoline, swing and pool for his young daughter and announced she would be returning for the summer.  In addition, subsequently moved into the basement and let his apartment in another town go.  When summer came we noticed the central air was not working and asked him to fix it and he said, "It’s not a problem, you can just buy air conditioners.  "Our landlord asked us to vacate our apartment approximately 6 months into the lease because he wanted to move his estranged wife into the apartment we were living in.  We currently have a lease which expires December 31, 2012.  However, we agreed to begin to look for another apartment in good faith.  The landlord at first implied that he could force us to move immediately but realized that the lease was binding and agreed to wait.  In the interim, he evicted the tenant upstairs and decided we should move upstairs but we decided not to enter into another agreement with them considering the landlord has not been truthful from the beginning. The landlord then asked us to move "as soon as possible" and agreed to pay our moving costs and return our security so we would be able to use it for another apartment.  We found an apartment paid a security deposit and asked for the deposit as promised to help us with our move.  At that time the landlord’s wife decided we were "extorting" them, refused to return the deposit.  In addition, this woman has accosted us, yelling at us in the street and at our door, telling us to move in the recent past.  Now, they say we should stay until the lease is up but we have already signed another lease agreement that begins on 9/15 and paid a deposit.  We want to move tomorrow!!  WHAT CAN WE DO??!!  HELP!!
