chipped paint

I have an issue with chipped paint in my california apartment that I’ve been renting for 5+years. My landlords is challenging the idea of repairing it do to "excessive wear" and "my lifestyle" causing the chipped paint. My concern is my 9 month old baby eating bits of chipped paint. He seems to be playing hardball because he’s also denied our request to end the lease as we search for a larger apartment for our new family member.
