Any sugestion to break a lease

By California

There was mold detected on two walls of the house we are renting.  At that time we did evacuate while the property management did repairs.  We were also told at that time we could break the lease.  Prior to moving back in the landlord tested the two contaminated areas but not the whole house.  We did move back in and my daughter continued to get very sick.  I have doctor notes to the school and even a letter the doctor wrote to the principle as my daughter was trying to run each week to avoid a bad grade.  Three months later we decided to move and the landlord is stating we can no longer break the lease that the offer to break the lease was if we decided to do it immediately once mold was found.  I want to know if this is true or if we have the right to break a lease.

Mold problem are very serious issue in health , specially for childrens. Now that your daughter is sick, she maybe ill due to this mold issue, take up this with your property manager and also show the doctors report, and if apartment owner is not completely cleaned or fixed the mold issue other then just at two places as you have mentioned, then this is a huge issue. I think you could have leaved the place at first time when contamination was found and as i think you won’t be having any proof of landlord saying once mold is found you people can leave the house. As you mentioned above he said you can break the lease, but if you have written words or in contract then good for you. Good luck
