can i take myself off my lease?

By jon r

i co-signed on an apartment in may of 2010 with another person. In june of 2010, our relationship deteriorated and i moved out. I went on to get an apartment on my own. In november of 2010, the person i had co-signed with, had a roomate move into the residence. This person has been living there since. I contacted the two to see about having my name taken off the lease and the new tenants name would replace it. unfortunitly the new tenant does not have the credit/income to be put on the lease. upon hearing this i went to the property manager to discuss my options. she informed me that not only could the new tenant not be put on the lease but that the two were two months late on rent. i was never informed from any party that rent had not been paid nor that any help was needed,  for had i been informed i would have paid it for them. the two do not have any intent to move out anytime soon. i am fearful they will get evicted and it will be on my credit. do i have any ground to stand on given the fact that the property manager knows there is someone living there who is not permitted to be there? or is there anyway i can avoid being affected by this?

When you moved out did you inform your landlord first and gave him a written notice to vacate the rental unit?
If so then your name should have been taken off the lease months before. If not then you are still entitled to pay rent and any late fees associated. I suggest that you serve your landlord with a 30 days written notice to vacate the rental unit and request that your name be taken off the lease. Good luck though!
