can the landlord retain a security deposit of a deceased renter

My friend rented an apartment for about 10 years. Always paid the rent on time. he passed away and we notified the landlord immediately. the landlord doesnt want to return my friend’s security deposit (to the decedent’s family members, not myself) because the renter didnt provide 45 days notice of intent to move – DUH, none of us know the day we will die so how can we give any type of notice? In a nutshell, the family wants their deposit returned minus any apartment damages.
