Is this legal to deny lease renewal based on weight?

My fiancee and I live on a second floor apartment with wood floors. Both of us are heavy set. My leasing office is refusing to let me renew my lease because when we walk we make the floors creek and the "ceiling shakes" according to the past tenants. The leasing office saw what size we were and let us rent a 2nd floor unit. The office is willing to let us stay in the complex if we go to a ground level unit. I like the apartment complex becaise it has heat and water included in the rent with ac, dishwasher, walk in closets, detach garage, pool, fitness center. Is this legal of them to do?
