Landlord raises rent after proper notice to move out time

By Matthew Person

My lease was up Sept 30th.  Required 60 days notice to move out (Aug 1st).  On Aug 19th my landlord notified me or rent increase to renew lease; because of this on Aug 20th I gave him written notice of move out.  I had called intially on July 27th to see if new lease terms; had to call again on Aug 19th after no response to 2 other calls in mean time to get the rent increase answer.  No responce to any correspondence before Aug 19th.

When turned in keys to full evacuated, clean apartment on Sept 30th; I was told i owe 2 months rent for not giving proper 60 days notice.  I had no intention to move until the rent was raised.  He is also holding my deposit which in Florida he has 15days to return or 30 days to give me notice why not returning.  He wants one months rent as "good faith" that I will work with him on improper notice.  I feel that the notice provision, of the lease, was waived when he gave me notice of rent increase inside the 60 days.  The statute says if not in lease, i have 7 days to give proper notice.  I feel I did that.

Please help.
