Noise issues, 6 people living in a 2 bedroom

By Kimberly

I have a 12 month lease, and about 4 half months to go till it is up, however a month after I moved in the apartment above me was rented out and I have been living in misery ever since.

The noise is unreal, it is all hours of the day and night.  Sounds as if they are always moving furniture, or jumping up and down for the hell of it.

I have made complaints to my apartment management, letters were sent, and nothing has come of it.  Frustrated I went to the office again and complained.  I was informed that 3 reports from security had to be filed so that they can take action.  I have done that, and still nothing comes of it.  There is no resolution to the issue.  The neighbors laugh and make more noise.  If I yell back they pound harder.

I have cracks in my ceiling and nail pops throughout the apartment due to the stress they are causing on the foundation.  There are 6 people, 3 adults and 3 small children living in the 2 bedroom, I have informed the management that its a violation of code, and still nothing is done.

The only solution the manager came up with was for me to move into another apartment, an inconvinance for me, as I am nto the problem and would have to change all my utilities and be charged fees.

What else cn be done, can i get out of the lease?  Why should I pay rent to live in absolute misery!?!

 Any help would be great…thanks!

Unfortunately 3 adult are allowed to live in a one bedroom apartment and the children have no bearing on the building or health code. My suggestion to you would be to call your local police because I’m sure there is something written in the lease about a curfew or even in you city code. They are disturbing your peace and quiet. I would also recommend that go to the website of you Secretary of State and see if there is a Landlord Tenant Act and if so, download it. Landlords have responsibilities to their tenants . I hope this helps

IT DOES MATTER HOW MANY PEOPLE ARE IN THE APT AND HOW MANY CHILDERN AND ALSO THE SEX OF THE KIDS BOYS AND GURLS OF A CERTAIN AGE ARE REQUIRED TO HAVE SEPERATE ROOMS …..ALSO YOU CAN ALWAYS CALL THE COPS THERE ARE NOISE CODES FOR THE CITY BUT ALSO ANY NOISE THAT IS DISTURBING TO OTHERS. FOR EXAMPLE THERE IS A CERTAIN TIME FOR CONSTRUCTION AND CITY WORKERS TO START MAKING NOISE ALSO ONE FOR GENRAL NOISE OUTSIDE AND INSIDE SAY ITS AFTER THE CITY TIME AND YOU ARE ALLOWED TO MAKE NOISE OUTSIDE THAT DOES NOT MEAN YOU CAN SIT OUTSIDE AND BUMP YA MUSIC IF IT BOTHERS ME I WILL CALL THE POLICE AND THEY COME OUT AND MAKE THEM TURN IT DOWN …..
