Retaliation laws and effect

We have had problems with our downstairs neighbors since we moved in in February. They were constantly cranking their stereo up with unbarrible base that would ratlle my tables and pictures. They are constantly partyin and being loud at all hours of the night and to top it all off our landlady and her husband join them. We have called the cops several times and just recently filed a formal noise complaint with the police in which my boyfriend was named a victim. Two days later at 7 p.m aproximately our washer was unbalanced making some racket. The downstairs neighbors called the police on us. Is this not retaliation and is this legal for them to do. What can we do about these rowdy neighbors.

Check with the city about exact wording of noise ordinances. It can be difficult to formally file a complaint unless the City (or municipality) has laws against noise, and even they they are usually restricted to certain hours (such as after 11 pm and until 6 am).

If the police have half a brain, they will not become immeshed in a tit-for-tat fight where the neighbors complain because your washer became loud one day. However, you now know that they they will be on your case about ANY perceived violation of anything, so be on your best behavior. And watch out for vandalism, because people who “party” and become incensed have been known to resort to other means to get their pay back. (I know this from personal experience)

If you think that your landlord is retaliating against you as a result of asserting your legal rights as a tenant, you seek legal advice to discuss your situation. It is also a good idea to document everything. Make sure that you keep a record of everything that is going on, including the dates of each event. Naturally, retaliatory acts are motivated by a desire for retaliation. Many tenants are unwilling to file a complaint against their landlord because they are afraid of retaliation, specifically of being evicted. But the reality is, you have protected rights and it is unlawful for him to retaliate as a result of you asserting or attempting to assert your right to demand peaceful enjoyment, as you have mention above that they are being loud at all hours of the night.
