Landlord wants to evict

By shelly

We are on a month to month agreement with our landlord. Well one day he came into the yard without notice and started staking the yard out to move a mobile home onto (in our front yard). We went to our local town hall and asked if he could move one in or not. Well he found out that we asked and a few days later we got a letter stating that they no longer wish to rent to us. We have found a house and plan on moving, however, we will not close until 24 days after he wishes for us to be out. I had a phone conversation with him and told him just that but to better protect me I also tried sending him a certified letter stating what we had discussed over the phone and that we are unable to move by his requested date. However, he rejected the letter which I have left sealed. Oue rent is due and I called to tell him I could meet him to pay him and he said he wasnt taking any money from me. Thats fine. But should I go ahead and make check out and send it certified even if he refuses then when we go to court he cant say we didnt pay. He says that he is going to the court house in a few days to start legal procedings to have us removed. We have three small children and he didnt even give us 30 days. What are our rights and is it worth it to hire an attorney?

Landlord wants to evict

By shelly

Our 6 month lease expired and we are on a month to month. However one day our landlord was outside in our yard without notice staking the yard for a mobile home. We went to our local town hall to ask if it was possible for him to move one in that close to another home. Our landlord found out that we had done that and a few days later we got a letter stating that they no longer wish to rent to us. They asked us to be out 3/6/12. We found a home to purchase however we will not close until about a month later. We have three small children which he is aware of. I had a phone conversation with him where his wife butted in and was ranting about us complaining about the mobile home. So once I got off of phone I typed letter stating that we would not be able to be out by the 6th and sent it certified mail. However he rejected it. Our rent is due..I called to pay him and he said he is not accepting it and that he is going to court house to start legal procedings. Shoudl I go ahead and send check certified so he cant say we didnt attempt to pay? Also is it worth it or needed to hire an attorney?
