Problem w/ final invoice – move-out

By lisa

I gave my letter to vacate at the complex I was living in. Before the final month I never received a pro-rated bill, I attempted to pay what I calculated as pro-rated for the final month. After the past due date I received a 3 day notice of non-pay, which they stated they do not accept partial payments. The notice included a higher pro-rate than I calculated and a late fee. I tried to get a correct invoice, I tried to pay, but now it’s a matter of principle. I was taken to court but the complex did not show up. The case was dismissed. When I received my final invoice it included past due rent, cleaning, utilities, late fees and court cost. I have been debating the invoice with the complex as I feel the late fees and court cost are no longer my responsibility beause they did not show up to court and I was dismissed. I agree to pay the fair pro-rated bill plus the cleaning fee and since the complex would not agree they have re-opened the court case and I am pending a date to appear in front of a judge. I feel I am being bullied and in jeopardy of a judgement and poor credit reporting. How can a complex get away with unjustifiable fees?

Seek legal advice. If you happen to be in a court, you must have a lawyer right? Ask him the things you should do and shouldn’t. He can answer the things you want to know.
