Problem Tenant Kay US Landlord

I need some advice.  I had given my tenant a contract to read over, which she didn’t sign, 4 years ago.  I stated in the contract that I am only prepared to pay X amount for Water, which is included in the rent.  Last Jan. I increased the rent by $50.  I did not write up a new contract, but advised her by letter.  Last month the water bill was significantly over the agreed amount that I am willing to pay.  She has refused to pay citing there may HAVE BEEN A LEAK.  I think she had been using a childs pool which is why the bill increased. Can I deduct it from her deposit?  I am in the process of writing a new contract and will ensure she signs this one.

Unapproved Pet Roger CA Landlord

Just found out my renter has had a pet.  I confronter her and she said that she has had pets visit from time to time.  When I was in the unit I could see evidence that ther had been a dog in the place (fur on the ground, nose marks on the glass slider,etc) The lease states that no pets are allowed on the premises. My question is – the lease is ending next month – how do I handle as far as the deposit.  I would of charged a $250.00 pet deposit and kept $100.00 to use for stream cleaning.  Thanks

Water compnay charging me for past renter bill Jennette CA New Landlord

Can a CA Water company make the landlord liable for a deliquent water bill from a previous renter? My new renter wants to set up their account and they wont let them unless I pay the balance of the old renter’s amount.  Also found out past renter added me as secondary account holder without my authorization. Am i protected? what can i do to not have to "bail" out past renter.

Rental House with a POOL Courtney S. CA Landlord

Hello there! I need some advice and quick!

I have a rental home in South Santa Clara County – California that has an ancient pool. The pool has given me serious headaches since I bought the property three years ago. Now the pool has black algae and after three different estimates on #1) remodel vs. #2) remove and fill it in – I have decided to FILL IT IN and be done with it. Bottom line is that the remodel has come down to REPLACEMENT of the entire pool due to it’s current condition. That estimate is around $17K. The fill-in estimate not including permit is $7K.

The property management company I use is saying that because the renter is in mid-contract with me I will have to reduce the rent quite a bit to compensate for the loss of the pool. The renters have been great and they have lived there two years, but have rarely used the pool because of all of the issues it has had. I have a regular pool maint. guy, I have approved all repairs that the renter has requested. I am “OK” with the prop. management company as they are nice, efficient and their monthly percentage charge is reasonable. But this issue is really bugging me now.

MY QUESTION IS: DO I REALLY HAVE TO REDUCE THE RENT AFTER PAYING $7K TO FILL IN THIS NASTY POOL?? AND IF I SHOULD, WHAT AMOUNT WOULD YOU RECOMMEND?  I AM THINKING $100.00/MO OR LESS, LIKE ZERO!

Tenant from hell. Sparky US New landlord

I’m a new live in landlord who rented out the spare room for the first time as I needed the money to help pay for the mortage. My tenant paid his deposit (provided reciept) but didnt sign a contract. We had verbal agreement that we’d give a month notice if he was to ever move out. After a few weeks of living with this chap things started getting weird. He started stalking me, going though my post, emails, alienate my friends, the final straw was threatening my girl friend in a sick email as he was convinced he was in a relationship with me. I gave him a months notice. He moved out the following day leaving me in the shit. I told him he didnt keep to the arrangement of 1 months notice and due to the lack or respect, behaviour, harrasment and making me feel uncomfortable in my own home he will not be getting his deposit back. He is now turned it all around saying I forced him to move out etc and taking me to the small claims court for his deposit. Please help as I am worried and not sure where I stand on this.
