My landlord just posted on my door that beginning November they are going to start charging 10 dollars a day for rent past due I was just wondering if this is legal for them to do or not. I kind of figure it is but I just wanted to make sure before I filed a complaint. Also another question in the contract it says you recieve free cable. I have lived here for over a year now and in the past 3 months have lost 3 channels. I guess my question is should they be responsible for getting them channels back working or as long as you still have one channel is it considered legal being that it is free and they dont state what channels are free. |

At the time I moved in I checked the cost for heating over the winter and it was within my budget. After further exploration after I moved it, the cost for heating in this apartment is much higher than comparable housing in the area. I spoke with a heating expert who checked my place for a gas leak earlier and he said the heaters were from the 60’s. I will be negotiating directly with my landlord to see if she will replace the boiler, but as she does not pay the cost of heating it seems she will have little incentive to do so. Is there any law that would provide that incentive? |

My landlord wrote me a personal check for the return of my deposit. When he handed it to me he said he deducted $400 for a scratch on the wood floor. Besides the fact that the scratch was already there, $400? My question is more about whether or not I should cash the check he gave me for less than my original deposit? I am most definately disputing the $400 but I need the remainder of the deposit to use toward my new place and can’t afford to just not cash this check? Can I do that and still dispute the $400 he deducted? |

Hi, I recently moved out of my apartment and have now got a notice from the management that they will be charging me to replace the carpet in the entire unit due to "matted and dirty in high traffic areas". Is it legal to do that? I stayed in the apartment for 1.5 years and vacuumed regularly, but admittedly some portions of the carpet were more worn out due to heavier traffic. I’m not sure if the entire carpet needs to be replaced for this reason. What are the questions I should ask the management to make sure they are charging me correctly? They have charged me $538 for the entire one-bedroom unit. Thanks, |

My boyfriend and I rent a store that we need to sublease. The landlord was fine with this as long as we found new tenants, and they pass a credit check. Our lease also states that these are the only requirements to be met. We found a new tenant, they passed the credit check, and have money for the security deposit. Good, everything is done, we just need to go sign some papers. SO, when we go to the office, I start reading the the sublet contract, and it says we will have $250.00 taken out of our original security deposit to pay for the lawyer’s fee for writing the document. I told him that he never said anything about this- he replies "you didn’t ask". When I got home, I looked over our lease again, and there is no mention of a fee for subletting. IS THIS LEAGAL? |

I am a renter in a small apartment complex owned by a larger company. I have been living here for approx. 3 months and have had my premise entered TWICE without notice. My question is, what legal action can I take if: 1) After the repair was completed, my premise was left unsecured? I asked for a repair and when I got home I noticed all of my windows (meaning every single one, including all rooms and main area) were left completely open. The window that is directly left of the entrance is only waist high from the ground, and EASILY accessible. This is scary because not only do I have valuables in my house, but I also have a 6 month year old daughter and wife that is home when i’m not. I have asked the owner of the property if they would allow me out of my lease early without penalty. The owner DID agree that they would do this, the problem is, I gave all the money I had saved as a deposit that I will not receive until 30 days AFTER I move out. My only other request was that they give me back my deposit BEFORE I move out upon receiving a written 30 day notice to vacate. I also agreed that I would sign a legally binding contract agreeing to certain conditions to be fullfilled (I.E. the apartment would be left clean and in a rentable condition. If not then I would be responsible for full reimbursment etc. I did not think this was unreasonable considering they put my family and property at serious risk leaving my apartment unsecured, ESPECIALLY with the consideration of EASE to enter (Waist high window in the front next to the door) PLEASE, if anybody can help me with advice, or even guide me in a direction on the best way to handle this issue I would forever be greatful. My new landlord has been doing improvements to the exterior of my house. At a snails pace. Been going on for over 2 months. During this time he put up a tent out behind the old broke down shed for his brother aka handyman to stay in. I let it slide, didn’t think it would be a permanant thing. They have changed the locks on the shed. So I am denied access to it. There is an extension cord ran from my house to the shed. When I unplugged it they just ran the cord to power pole. There is a garden hose extended from my house to the shop. I also have 3 garbage cans outside, which prior to 2 months ago I only managed to fill 2 of them up weekly. Now its 3 and sometimes an extra large garbage bag. Keep in mind no utilities are included in my rent. They have started painting my house at 6:00am and have still been painting outside my bedroom window at 8:45pm. They never let me know when they are going to be here or what they are going to be doing. I care for my disabled mother who lives with me and whos health has taken a turn for the worst. I have chosen to stay home with her til god either gives us a miracle or takes her. If moving wouldn’t be so tramatic to her I would move, but thats not in the cards. I have no idea how to deal with my new landlord since I have let everything slide. HELP!!! |

I came to look at an apartment with a real estate agent who is managing the property for somebody, and has been for a while. On the day I looked at the apartment, it was early afternoon and everything was quiet. He had the lease with him and I stopped before I signed it and asked if you can hear any noise from the neighbors because that is my one concern since I am a student and I need to study. He assured me that there was not going to be a noise a problem, so I signed the lease. Now, I have been here for a week, and I cant study, sleep, or even watch television because the music from below is so loud all day (it is a restaurant) and the noise from above is so loud that whenever they move, I can hear everything going on. I want to break the lease, but the agent now says that not only can we not get the security deposit back, and that we will not be able to get any rent back (we have only been here for 6 days), but he says they might also try to get us to pay damages. Since I have had this problem, it seems like everyone I talk to, including other agents, tell me that this unit is notorious for noise problems. Isn’t that agent responsible to me for assuring that there would not be a noise problem, especially since I made it clear that the only reason I signed the lease was because of his assurance? |

I have been renting this place for a year. It started out with 3 of us but one roommate moved out about 7 months into the lease. We have a new roommate but her credit score brings us down too much so now we aren’t qualified to rent the same place. The landlord said he could re-run my credit but it would cost us fifty dollars a person. I told him that I had my own credit report site that was less money but he said he doesn’t feel comfortable with that. Is it legal for him to not except a credit report from me? I feel like I’m being lied too. |
