I have lived in a duplex for over 3 years. My landlord is for the most part pretty good as in, reasonable prices, fixes things reasonably well etc. However, it is obvious that he only rents to women. He has himself stated that men “change the dynamics”. When I moved in the tenants in the other side were all female, when the head of the household began dating a man who spent a lot of time there, our landlord began watching the neighborhood, driving by at all hours, jogging by at all hours (nowhere near his home) and told me he was watching to see if the boyfriend was an overnight guest. He also questioned me repeatedly about how much he was over there. I was very vague as I liked the tenant and her boyfriend. Well, now it is my turn, I am over 50 and so is my boyfriend. Due to some unrelated issues he does not have a regular job so spends time at my place during the day, cleaning, cooking etc. I have told my landlord (cause I know how he is) that he doesn’t live there but he is rude to my boyfriend and is now doing the late night drives etc. Am I within my rights letting my boyfriend stay over a few nights per week and letting him help me with housework? I’m about to move so I need advice.

Moldy Carpet, Landlord won’t Replace… jaime OR renter's friend

My friend just moved into an apartment that smells very mildewy and moldy.  There is also visible mold in all of the windowsills.  The landlord had shampooed the carpets before my friend moved in, and there was no ventilation and OR is a wet state.  I’m not sure if that is why the mold is there or not.  But, my friend has asthma and is having a very hard time breathing when she is in the apartment.  She contacted the landlord about it and the landlord said the only thing they can do for her is shampoo the carpets again.  THIS WON’T HELP!!  They won’t replace the carpet or let her out of her lease.  It seems absurd that they can make her live there in those conditions.  It seems a huge health concern.  She has been to her asthma doctor and he has written a letter stating that she is in danger living in that apartment and needs to move.  If anyone has any advice about how she can get out of the apartment right now without any serious repercussions, please help!!

Late rent fee anonymous MD renter

This all started earlier this month we mailed our rent out on the 14 th of  march 775.00   ( 755 + 20 late fee.)

Our payments are to be post marked by the 6th of each month or we incur a $20 fee a second fee is due if not post marked by the 20th of the month.

Our land wanted us to pay a second fee because we were late.We sent her back copy of the payment agreement in her own
hand to remind her that payments are to be post marked by the 6th of each month or we incur a $20 fee a second fee is due if not post marked by the 20th of the month.. A few days go by we get another letter first saying thanks for the reminder then
she goes on to say we owe her $80.00 in late fees for 7/8/08  10/8/08 12/8/08 and 9/22/08  after looking at her records.

We are in the habit of getting the rent to the post office before noon the same day we get the cashers check from the bank.We found it strange all of of the ones she listed were mailed before these dates.When we checked our records  the dates  she gave are the dates the checks were cashed.We have the copies of all the payments sent. The dates are 7/4/08 , 10/3/08 ,12/6/08 &( 9/19/08  she wants a  second late fee for this one)

During Oct she was in China her husband was taking care of things while she was gone.We mention this because we received a
note from him  on the 15th  to get in contact with him in the next 24 hours about our rent (Yet she is claiming the 8th).We called him he said they did not get our Oct rent yet.
We told him he should have we sent it out on the 3rd as proof of this will would send him a copy of the cashiers check.About a week goes by we get another letter from him saying he did in fact get our rent. He also said they have had problems with the post office like this before.

Do we owe the late fees if the post office delivers the rent late?

Unlawful detainer Lonifinch CO Renter

We were given a three day notice to pay or quit when we were already on constructive eviction. There were pipes leaking in the bathroom, combined with poor ventilation, resulted in mold build-up. There was suffocating levels of secondhand smoke in my apartment, and exposed electrical wires. Then we found bedbugs in our bedroom. We went to stay at my mom’s (all rent was current at the time); the bathroom was supposed to be redone, the pipes fixed and mold cleaned up, and the bug problem treated. Eight days later, we found a live bug, the exterminator (Termimix) left chemical dust all over our furniture, and the bathroom had not been touched. The manager told us: 1) the mold is due to inadequate cleaning 2) Terminix “found no evidence of bedbugs.” 3) The rent increased by sixty dollars. 4) We owed $175 for the pest control and 5) we received the notice to pay or quit. We removed all or our furniture the next day and cleaned the apartment the day after that. We wrote a letter stating our intent to terminate the lease. Two days later an unlawful detainer notice was posted on the door. We went to the court hearing to ask for the possession for judgment complaint be dismissed, since we complied with the notice to quit. The attorney refused, then later assented, and dismissed the case. They now need to file a new complaint to have money issues heard.

My questions are as follows: 1) would the filing of the unlawful detainer be considered retaliatory actions? 2) What do we do about it? 3) Can we sue the landlord? 4) What type of lawyer would be best for our representation, landlord/tenant, personal injury, or something else? 5) They made sure we could not give permission to the premises to the housing inspector, is there a way to overcome this? 6) We want to prevent future tenants from suffering through these issues, how can we be most successful to that end?

Landlord trying to charge my guest… Sue IN friend of a renter

This is kind of complicated.  The apartment my friend just left is trying to charge her over a  years worth of fees for an unsigned lease.  They are charging her not becasue she did not sign her lease but becasue her roommate’s former roommate did not sign her lease the last year she renewed it.  She was renter1 of this apartment.  She then roomed with another girl renter2 who had her own lease with the complex.  Renter 1 moved out and my friend moved in with renter2 becoming renter3 in December of 2007.  Well renter 2 moved out and now my freind renter3 is moving out.  The complex charged her damages above the deposit which she paid because she knew when she moved in that she would absorb any damages previously there since the apartment had gone from roommate to roommate.  However they are also trying to charge her for an unsigned lease from the dates  3-1-07 to 2-28-09 = to over $700.

I went with her to talk to managment to understand this since she herself never had an unsigned lease.  They said when she moved in she absorbed all fees and damages.  The damages she understood but the complex admits that this rule is no where in the lease she signed.  Yet they are threatining to ruin her credit if she doesn’t pay the balance.  They said she could sue and they would win!  I understand that if she had damages but it is for fees from a previous renter.  Both renters 1 and 2 are no longer even living in this country.  I think they are just trying to bully my friend because she is foreign and young and an easy target.  They also know she is moving out of state in a week.

Is this legal?  Does she have to pay for a previous renter’s fees?  Does she have any recorse?

Landlord/Tenant disputes Hollie FL Renter

I have been renting a house with two responsible and clean roomates for a year. Our landlord never bothered to send our lease back with her signature even though we frequently asked. She never bothered to do a LOT of things since she lives across the country and does not appear to care about the property. We facilitated all repairs/lawn care/insurance &warranty issues/maintenance on our own. When lease end was approaching we notified her months ago that we would like to just take one extra month and then move out. This is when her claws came out. Issues that she had ignored for months became urgently important, she began blaming us for things that we had nothing to do with, denying her previous lack of assistance, and in our communications has been hostile, threatening, and dishonest about everything. We feel we a in a very vulnerable position and that she plans on unfairly abusing our security deposit. We know there should be virtually nothing to charge us for but we cannot trust her and, across the country having never met her, she could disappear from us very easily.

In one week our last months rent is due. Is there ANYTHING we can do to protect ourselves and avoid future legal issues???? Please help!!!

Apartment Air Conditioning Jenn IN Renter

It is the end of March here in Indianpolis but the weather has already reached 73 degrees. I live on an upstairs apartment and the inside temp is averaging 80 degrees because the AC is not working. I have tried three times already to get this repaired as it is very uncomfortable to sit and sweat in your own home. I keep getting excuses as to why they will not repair the unit. The last excuse was that the temp has to reach 78 degrees three consecutive days before they can check the freon. Well, to be honest, when the outside temp hits 78 degrees it will be more like 100 degrees in my apartment. I have done research with the city’s ac repair companies and they have all disproven the last excuse. I have my notes and will deliver them in person today in a final attempt to get this fixed. If they still refuse to fix the ac, what are my rights as a renter? Am I out of luck and forced to live in a very hot environment until they decide they want to fix it? Thank you for your help.

Landlord charging security deposit Andrew NY former renter

I lived in an apartment for 6 months, after moving out i heard nothing back from them about my security deposit for 9 months.  I was busy with other things and had forgotten about it, then recieved a letter from a debt collector saying I not only will not get back my security deposit, but I also owe an additional $210.  The original security deposit was about $1300.  I wrote back and asked for specifics as to why I owe money, and they sent back the walkthrough from the landlord saying the carpet was stained.  Even if the carpet was stained and needed replaced, I don’t feel like I should owe the full replacement on this carpet, as it was old and worn when I moved in.  Also, I was wondering what the policy was on interest on security deposits.  The interest they showed that I was recieving on my security deposit added up to be about 0.5%.  If you could help out on this matter it would be greatly appreciated, I’m stuck and don’t know how to proceed with this.

Early termination of lease… Wina CA Prior home owner / new renter

We are moving from Colorado to California and trying to find a rental through Craigslist postings. We found a home and told the landlord we had 2 small dogs. My husband went to see the home and found the fencing was not equipped to keep our small dogs safe.  The home was also in disrepair.  I called the landlord and apologized that we needed to get out of the lease.  We sent him a deposit and first months rent and signed a 12 month rental agreement. His responce was that he would talk with us tomorrow but that we signed a legal document agreeing to rent the home for 12 months.  I am unsure what he will say tomorrow but I want to be prepared with knowing my rights in this situation.

Can I lower rent? Susan CO retired, disabled, over 60 single

I just moved in to a new house in San Diego with my husband and 2 yr old baby. A week after we moved in, water started leaking from the wall separatng the kitchen and garage and the kithcen floor tiles started warming. The plumbing inspector identified hot water leak underneath the kitchen floor. Now they have to do digging in the kitchen and remove the walls! For 3 days now, we have to limit using hot water and must turn on and off the main gas tank. I’m so stressed out just thinking whta’s gonna happen when they start the work. Can I request compensation or decrease in rent becase of all these trouble?
