Can’t Control Thermostat Eileen PA Renter

I moved into a 2 bedroom apartment in a converted house with a smaller apartment in back of me and upstairs. The only thermostat is in my apartment. The guy upstairs complains his apartment is too hot and complained to the landlord. Now she insists I keep the air conditioner on at 74 degrees even though it is too cold for me. She says if I don’t, she will put a lock on it? There is nothing about it in my lease. Can she do this?

Roommate Breaking Lease Tenant

My roommate and I signed a 12 month lease. At the end of 10 month my roommate has decided that she will be leaving because she does not have a job and cannot afford to pay rent. We have tried to the speak to the landlord to come up with an amicable solution but they are refusing to speak to us. I have even offered to rent their empty 1 bedroom apartment and sign another 12 month lease if they let us out of our first lease contract. I have a really good relationship with the property manager but my roommated does not. She does not care if the landlord puts this on our credit report. My question is since my roommate is creating this situation – I have no problem paying my portion of the rent – why doesn’t the landlord simply go after her?

I am trying to work out a solution but the property manager notified me that the landlords don’t want to speak to me. What can I do in this situation? If I also move out when my roommate moves out. Can they report this to the credit bureaus without even trying to resolve this amicably?

Lease expired… fif NJ renter

We had a signed lease from Nov 2006 Oct 2007.  Now we are moving out – back to Germany and seem to slide into truble with the agent. We did not sign a follow up lease that was sent half a year ago, after we lived one year without contract as we knew we were going home this summer.Besides sending the late follow up contract, the agent was not responsive during the 2.5 years and know the agent says she wants to enforce the contract, claims the first contract is still valid, and is not cooperative on the phone regarding showing times, for example.The agent wants to put up a Lock Box and with 30′ notice, any agent can show the house.  Is that common?  We have little kids that still nap and don’t want to be a sight seeing place… What would be reasonable warning time and restriction in the time window (the first contract says: 10 AM to 8 PM). In general, are the rules from the first contact still valid or do we have other NJ law that governs, for example, when we have to available ot for showing, to give notice? As we leave the country, I’d like to use the deposit for the last 1.5 month.  Any lega chance to do so – I heard it is common practice to do so. Is there a NJ renter protection association that we could speak to?Thanks, Fifi

Tenant Mediation Carol B MN Helping my father who is a renter

My father was moved to asssited living in March due to medical conditions.  We cleaned his apartment extra thoroughly including cleaning the carpets 2 times and vacated the apartment early to give the landlord the opportunity to rent sooner.  My father’s landlord is attempting to charge damages above the security deposit amount my father paid.  I have made a counter offer suggesting they take some of the security deposit but return a portion.  QUESTION:  When should I seek mediation?  QUESTION2:  I know that the apartment has a renter for May, do I have to may May rent?  We gave 60 day notice on March 11.  Thanks

Landlord Rules… Mary NY Renter

My land lord requires that if you want to move something out of the apartment you book a freight elevator. I sold a sofa and tried to book the elevator. My landlord has refused to grant permission unless I come up with a notarized letter saying I am will be responsible for the rent for the remainder of the lease. Now I have never once failed to pay my rent or even paid it late! And all I am disposing of is a couch. My landlord rules seem very unfair.  Is this legal, can a landlord prevent you from getting rid of something you own or require you to get a legal note before you can do it? This sounds utterly ridiculous to me.

Landlord charging for repair Roz CA Renter

My shower door busted. i have NO idea how. I thought it was from the extreme heat my apartment holds and i was out of town for the weekend, came home and found it shattered. Apparently this is unreasonable, and my landlord wants to charge me for the damage. OK fine, but my uncle is a licensed plumber and can replace the door at no costs to me, but my land lord is being shify about that. Why should I have to PAY (people she found) when I can get it done w/o costs to me. (especially when i feel i’m not even responsible) HELP

Extermination clause in lease agreement lawful Lara NY Renter

Due to our lease agreement we as tenant must contract and pay for all utilities and service, including but not limited to gas, electric, oil telephone, cable television, lawn mowing, gardening exterminating and snow removel.

A few days ago we he had hundred of swarmers. We informed our landlord and he responded it is our problem due to the lease agreement. I called an Exterminator he told me we have termites and its going on for a while and maybe the termites have been in the house before we moved in. The cost of a long term treatment a estimated 2,400.00 Dollar. The basement is unfinished and in not good condition. Do we have to pay for the treatment?

Can someone please help me?

Laid off- is there anyway to get out of lease? Jenny TX Renter

My husband was just laid off last week so we are having to move back home (about six hours away). We will be living with family because we simply can’t afford to pay all of our bills with my pay alone. The problem is our lease is not up until December. The apartment said there is no way to get out of the lease unless we are in the military. So, we are expected to pay all seven months of rent when we move out (it will be about six thousand dollars, which we don’t have!). I know that we signed the lease, but my question is, do we have any recourse? I understand that the apartment needs to have some sort of fee for breaking a lease but this seems unreasonable and there is no way we can pay it. Help!

Threatening eviction without cause Tenant

I moved into my apt with a friend of mine back in Sept ‘08.  January we had our first complaint.  My roommate showered with music on (around noon on a Saturday).  We found a note on the door a few days later as a courtesy by our front office informing us there was a complaint.  When I called the office to find out what this was about I found out the neighbor had initially complained about that incident but when the front office said it was during the day the neighbor added we had a party and music was turned up until 4am.  (FYI, there was no party…we were asleep long before that)  I informed the office there was no party and she said it was no big deal.  I told her to make sure if he had any issues like that again, to call the police.  I would much rather there be a record of an incident or lack thereof.  The 2nd incident was again on a Saturday, 5pm.  I was playing music (and not at all at a loud level) for approx 20 minutes before I went to work and he didn’t like it.  This time he came knocking on my door.  I didn’t answer.  I called my office on Monday and told them to inform him to never knock on my door again and he should contact the police dept if he has any further complaints (again).  The 3rd incident happened this past Sunday at 730pm.  I had my music barely audible outside the room I was in and he came knocking on my door.  I again looked through the peephole and didn’t answer.  He left and returned 5 minutes later.  Again, I didn’t answer.  I turned off my music at 750pm.  The front office contacted me on Tuesday to inform me of the complaint.  Supposedly he called the police who told him to let the front office know he had called.  Police were never dispatched because it was before the 10pm quiet hours the town has.  My front office tells me I’m on temp probation and if I get another complaint they will seek to evict me.  I told them that if they were going off of just what he says and no police reports, he could just lie and say whatever he wanted.  She had no response.  So, now what?  Can they really do that?  If they do evict me, am I liable for paying the remaining balance on my 1 year lease?

What do we do it the landlord doesn’t show up for final walk through? Itawei NY Renter

We have been renting this place since 1/05. The lease expires on 4/30/09. In January e told our landlord that we won’t renew it. He never got in touch with us to discuss this it. In the meantime he hired a realtor. Last week we sent him an email and told him our moving plan. We told him that he has to be at the house for the final walkthrough. If he would be unable to come, he can give the authority to a person of his choice. We insist on getting a written authority letter signed by him. This letter has to include the name of the person who can act on his behalf. His signature has to be authenticate by a notary public. This action is necessary because he is our landlord and only he can take over the apartment. The ownership of this duplex is not clear to us. In my opinion it really doesn’t matter. His name is on the lease contract and that is fact. We haven’t gotten a reply so far and we might not get one. We are sure that this family tries to trick us. We gave them a 2.5 month deposit. We live close to NYC. You can imagine how much money that is. We always paid the rent on time. We are going to leave this place spotless. We would do everything to make this so smooth as possible but our landlord doesn’t make it easy.

My question is: What do we do when he doesn’t show up on 4/30 and nobody else shows up? If you have any other suggestions which could be helpful to us, please post them. Thank you.
