I have been renting my apartment for 10 years, and the carpet is worn out.  When should carpet been replaced after normal wear and tear?

i dont have a lease with my landlord.ive made many complaints about my neighbors and have called the police many times on them.my landlord will not do anything.hes says to try to get along with these neighbors,i cant do it ive tried.all the wiring needs to be replaced and half of the outlets dont work.he really is a slum landlord.hes says if we move out we will get charged another months rent eventhough we dont have a lease.is there any way we can take him to court to get our deposit back to help us move eventhough we dont have a lease with him?i dont want to have to pay legal fees.we are at the end of our rope.i need some advice please.

Rental Refrigerator Repair Forced to Fast Food TN New Renter

I’ve been renting with this specific property management agency for several year now, and I must be stupid to have stayed here this long. We’ve had several appliances break down, and it typically takes several weeks for anything to be repaired. Our refrigerator melted, and we called every day for 5 days before it was replaced. I actually had to resort to using friend’s phones to call my landlord because he ignored my number. Now we have moved to a larger apartment in the same complex and the new refrigerator (which I had to move myself) has also broken down. I have about $200 of groceries in it, and I can’t afford to wait another week to get a new refrigerator. What should I do?

What Is a Fair Concession? Tenant

I moved in and immediately notified the office that the carpets were too wet to put anything down. They did call a cleaning company, but since they had just been done, it would take a couple days to dry. Even after turning in the condition statement and notifying every few days, I did not have a shower (bad plumbing) to use for the entire month, the stove did not work, smoke alarm inop, inability to secure windows, etc. After repeatedly going into the office, taking the managers, it finally got fixed after 4 weeks. They only want to reduce my rent by $100 for the month ($658 to $558 – 1 BR, 1 Bath). I don’t think this is a fair amount. They say that is all they are authorized to give (normally only $50).

What can I do?

Judgement against primary tenant Carmel26 NY Rentor/subtenant

I have been subletting an apartment(in a private house) from the prime tenant for about two years.  The primary tenant moved out of the apartment over a year ago and I as well in another tenant is still living in the apartment. The owner(landlord) of the house started a non-payment petition against the primary tenant even though she knew this tenant is no longer living in the apartment.  The landlord claims to still have a lease with prime tenant(which i was unaware of) and is using the lease as way to get an eviction case against me and the other tenant who is still living in the apartment.

Although the landlord has this lease with the primary tenant, she has been collecting rent from us(subtenants) for the past two years. Because she was collecting rent from us, we were no longer subtenants…we became her tenants. Infact she has been collecting the rent in cash without providing receipts. Whenever i asked for a receipt, she refused to provide one. I sent her a certified letter threatenent to withold a percentage of the rent due to problems with house and requested that she provide a receipt.  Ever since thin she has refused to collect the rent from us and has attempted to illegally evict us. Now she has this non-payment petition against a tenant that is not physically living in the apartment.

the first court hearing the Primary tenant never appeared.  I think the landlord planned it that way. I think the landlord is trying to get a default judgement against this tenant in order to start an eviction case without having to take her us(the subtenants)to court

WHAT SHOULD I DO?

Extra charges after moving out Tenant

I moved from a house that me and my husband rented for 12 years. I gave the required 30 day notice to landlord.The day after moving I  met with the landlord at the house to return the keys and do a walk through.All seemed to be o.k. A week later the landlord sends a condition report to me saying the house was dirty and grimy with smoke damage.The lease agreement does not say that i could not smoke in the house.The landlord has been to the house many times for needed repairs but never once say anything about smoking in the house.Now the landlord wants to charge for cleaning everything for smoke damage.Per the letter i recieved , walls,light fixtures,air vents,blinds etc. , must be cleaned using special cleaners and will take extra labor hours to clean.(What are special cleaners anyway?)I cleaned the house before moving out.I dusted the blinds,swept and mopped the floors and baseboards throughout the house,and cleaned the bathrooms and kitchen,and appliances and shampooed the 2 carpets in the house .I consider this a basic cleaning most renters would do when moving out. One of the carpets in the report i was sent said possibly ruined.I wonder about 12 years of wear and tear on carpet.Also some items I am being charged for are removal of a birds nest. (where it was I have no idea.),and landscaping in the yard which was approved by landlord.Once again during the walk through none of these things were mentioned to me as needing to be removed or cleaned .I was never shown a condition report or signed anything after doing the walk through.The letter I recieved from the landlord now states that my deposit(deposit was 850.00) will be retained along with other charges up to 1500.00 for cleaning and sanitation of the property to bring it back to the condition it was in when i moved in.As of this date I have not seen any reciepts as to work that has been done to the house.What recourse does a tenant have against eroneous charges I believe to be false.

move out charges Tenant

We are currently renting from Avalon in New Jersey, they have over 3000$ from us as a deposit. We are two adults living in this 2bed/2bath apartment (1000sqf). I always pride myself with keeping the apartment neat and clean. Regulary clean the windows, the fridge and oven etc. The apartment is in excellent shape. 

Our move out date is July 18 and we just had the first inspection of our apartment.  During this inspection, we were told that they will charge us 150$ for carpet cleaning, 300$ for "other damages" (not specified) and 1500$ for cleaning! I was planning on doing this myself, for it will be a simple job since the apartment is in such good shape, I was told that I would never be able to meet Avalon’s standards when it came to cleanliness. I think they are just out to keep as much of the deposit as they can. No cleaning company charges 1500$ to clean 1000sqf, right? I don’t know what we should do. I am afraid that if I clean the apartment myself, we will still be charged the 1500$ and that would really make me angry. Any suggestions on how to proceed? Can we argue these exorbitant charge for cleaning?

Bed Bugs – Grounds for termination? Tenant

I moved into an apartment in Boston one month ago.  About a week and a half ago, I found a bed bug after experiencing several bites all over my body.  I contacted our onsite management contact, and he told me that the two apartments below us have had a bed bug problem for several months.  They treated our apartment once (they claim they did this preventatively) before we moved in, and we have obtained a document proving this treatment.  However, even though Boston Housing dictates that they should be treating all adjacent units to the effected united, the management company has not been doing so all along.  I did NOT have bed bugs/have never had them before nor had I been traveling – I’m positive I got them in this building.  I have had to spend several hundred dollars on mattress covers, a new vacuum (mine didn’t have a bag, but you need a vacuum with a bag to treat bed bugs), dry cleaning, laundry, etc.  I am covered in bites, cannot sleep, have nightmares when I’m sleeping elsewhere.  They have exterminated once, and I’m trying to cooperate with the management but they are not returning my calls.  The people in the other units say, despite extermination every few weeks, they still have bites everywhere.  Because this was known to be an issue before I signed the lease (and I have proof) and it’s effecting my health, can I terminate the lease?  Is this a form of constructive eviction? Any advice would be wonderful  – I am dying to get out of this living situation.

Can Landlord charge me for… Tenant

Is it legal for my landlord to present me with their Sanitation bill and expect me to pay it monthly?

Is it legal for my landlord to say rent is due on the ist before 6:30 and put on a $50 late fee if it is late (on the same day)? Plus a $35 per day charge after that? I always thought it was due on the first and late on the fifth.

harrassed by the manager of the mobile home park Tenant

I have recently moved into a mobile home and I am constantly harrassed by the manager of the park. Unfortunately he lives the home next to me. First he was upset by my dog barking even though he also has a dog that barks. I purchased a shock collar and have been using it to control my dog’s barking and I let him know that I was taking actions to stop him barking. (dogs are allowed in the park) I live alone and do not want to loose my dog. Since then he is constantly coming over and complaining about something. I had a car that I sold in my driveway and I was waiting for the buyer to pick it up. The plates had expirted and he said he would be there within the week to pick up the car. The park manager told me I needed the car gone in two days even though many tennents have unlicensed vehicles  on their lots. He then proceeded to call the police the same day. When I first moved in he entered my mobile home twice without permission when we were moving in boxes. I was trying to have a good report with him so I let that go. He okayed for me to have a carport and then proceeded to yell at my sons when they were putting it together. He does not treat other tennants the same way, infact many of them break park rules without any repercussions. I have spokent to the police and told them how he is constantly harrassing me for every little thing. I heard him tell the police that he could use that lot to put his cars on. .. maybe he wants me to move out so he can have the lot. I cannot take mush more I had surgery and he is constantly knocking on my door, I told him I am recooperating and cannot keep coming to the door. His irratic behavior scares me. This winter he plowed in my friends car when she was parkced in a handicapped zone and would not stop to remove the snow. When he talks to me it is very abusive. My question is is renting a lot the same as renting housing and do I have the same rights. I cannot believe he has all this power to threaten me and make my life misserable. Help!

 I also have health problems and the constant stress of this harrassment is making them worse.
