Withholding Deposit Tenant

We rented a home in Colorado for a year.  We signed a one year lease and did not do a room by room inspection.  The landlords are withholding $750.00 from our deposit.  They claim we left the house not in the condition in which they rented it to us.  However, during the walk through, one of the landlords said they were hiring a cleaning crew to clean the oven and blinds in which I did not clean.  I agreed and got a bill for from the cleaning crew of $400.00.  The first letter by the landloards stated many items in which were not done properly.  However, my husband was there cleaning it while they were there working and did not state anything that needed to be done.  We sent a certified letter stating things that were under question and we did not agree with.  The second email they sent had other items not addressed in the first letter.  I feel like we are being taken advantage of.  We had issues while we rented the home.  The basement leaked a large amount of water and mold began to grow for two months.  The mold grew on the concrete walls and wood frames.  The landlords never took care of the issue for several months.  The upstairs bathroom was covered with mold spots.  The basement bathroom had a huge water bubble popping out of the wall.  They came once to take care of the basement and it continued to do it again.  I feel that they are wrongfully withholding our deposit and I don’t want another family to live through what we did.  My daughter and I are allergic to mold, have allergies, and asthma.  We had health issues throughout living in this home.  Plese let us know what we can do.  We no longer live there and it is rented out to someone else.  I contacted the health department and tried to reach a conslusion with the landloards but they will not return a large portion of the deposit.  Please help.

Problem with landlord repair Jessica TX Renter

We have been renting a single family 2 story home for 3 years. For the past 6 months I have contacted the lanlord (realestate agent) that the ceiling above the living room is sagging. When you push up on the sagging beams you can actually move them up. When you walk on the floor in the bedroom upstairs from where the beams are sagging you can actually see the ceiling bow down worse. On maintanence man came and looked at it and said it could very well be a problem but that he was there to fix the leak under the slab of the house and would look into it later. Well I signed another lease 2 weeks ago on the agreement they would come look at the ceiling and reassure me that it was not a safety issue since they never came back to look at. I was told they would have someone come out. I signed the lease then got an email  back from the realestate owner stating he remembers the sag being there before we moved in? WTH? Can I call the city of garland and have them come look and see if its a violation or a safety concern?

Landlord Repair Responsibilities Tenant

I am preparing to renew my lease for a cafe in Texas.  My current lease says that I am responsible for all repairs (including plumbing, AC, heat, etc.)  The only thing listed as the landlord’s responsibility are problems with foundation, exterior walls, roof, and ‘other structural components.’  I know it’s legally binding because I signed it, but, before I renew I would like to know if this is the standard for commercial rental in Texas..or if it is even legal.  Thanks!

Lease Cosigner IL Former Renter

I co-signed a 12-month lease with my son and daughter. The home had a swimming pool which we have to carry a 1/2 million dollar policy on. The landlord found that prior tenant had torn liner and other stuff did not work. She hired someone to get estimate on repairs. In July property manager called and said landlord was not going to open pool and we could get out of the lease. As my son had enlisted in the Army and we could get a smaller place. We started to look for a place at that time. We found a place that would allow my daughters dog in September and when I told the property manager, she kept stating that we are responsible for the rent. We would not have looked for a new place had the manager not said we could get out of the lease.

Bed Bug Infestation Big D OH New Renter

My fiancee, daughter, and myself recently signed a 12 month lease with a very nice landlord. We moved in last tuesday, only bring the basic necessities for our first night. As we put our daughter down to bed we called it an early night. At some point I woke up to the feeling of little legs crawling on my neck. My natural reaction was to smack or squish whatever it was. I looked at my hand afterwards and there was a fair amount of blood. My fiancee and I got up and went to the bathroom and discovered little bugs crawling all over the floor, the sink, the tub, etc. I caught one in a bottle and proceeded to determine what it was. It turns out they were bed bugs.

We woke my daughter and checked her for bugs. She was fine, but we noticed a bug by her closet door. Inside of the closet were countless bedbugs. We realized we were surrounded by these heat-seaking nocturnal assassins! On the baseboards, on door frames, in the cracks of the stairs, EVERYWHERE. We both realized we had bites on us. We went back to our a room to find them all over our bed. Needless to say we left immediately. We left everything there and went to a motel.

Our landlord was shocked to find out that these bugs were there. He said he had no idea what so ever and apologized repeatedly. My brother lives in the same complex so while venturing to his place to discuss last nights problem I ran into another tenant. I asked if she had any issues with bugs. She laughed and said yes. That she has been fighting off bedbugs for months and the landlord refuses to do anything about it. Our new neighbor was outside and spoke up that she had them as well.

We’ve spent $300 staying at a motel because we can’t live in our new apartment. Our landlord has used a basic spray chemical (the kind used outside for ants, beetles, etc) to essentially soak our apartment twice in 3 days. This alone is a misuse of the chemical and would put my crawling daughter at risk.

Our landlord lied to us about knowing there was a major infestation of bugs. We killed 50+ of them in a 45 minute period in our hallway ALONE! My question is does my landlord legally have to reimburse me for lodging because he failed to hold up his responsibiilty to provide a habitable and sanitary dwelling? He agreed to terminate the lease and refund our deposit and rent but we’re still out hundreds of dollars as well as bedding, clothing, and other things that are now infested with these bugs.

Any advice will help.

Landlord Sewage Backup jeffcsr CA full time student on ssi

I have feces coming up my shower drain everytime my neighber flushes his toilet, or uses the sink, because my landlord wont fix the sewage backup. my oven has never worked,in the last year my apr has become infested with cockroaches,,most of the 3 in siding has falling off the wall 3 of my cupboards have fallin , the owner has ignored all my conplaints, and now raised my rent,,i have nat paid for the month of oct, and now instead of fixing the prob,,,i got a eviction notice,,,what do i do

Rental Repairs and inconveniences of moving out Tenant

I have been in my apt for 16 months in November. 8 months ago my bathtub drained into my kitchen, leaving it in a pool of water. The plumber had "fixed" it. Last week my tub did the same thing, and left my kitchen in an inch of water. Not only am I worried about the appliances plugged in sitting in this, but my health and inconveniences this has caused. The ceiling is bowed entirely, and the plumber has said the damage has been on ongoing issue for quite some time. God knows what’s lurking in this place. I have asked my land lord to get a new apt. They are treating me as a brand new tenant. They are holding my first 575 deposit, making me pay rent on the first (600), pay another 575 deposit, and also, if I move in before the 1st, I’m reliable for a pro-rated rate of 20$ a day to move in early. This seems completely unfair to me that this is their problem, and I’m stressed out about it. They are being completely inconsiderate of my health, and making this impossible to just be in a clean sanitary apt. What should I do?

Bed bug infested furniture Sleepy TX inquiring minds want to know

I live in a senior building. Some to the tenants are disable. Some of my neighbors had a bed bug infestation and one of the couple was disabled. In the mean time the management informed the that they had to throw the furniture away which they did.

The couple threw away everything. The other neighbor threw her furniture away and replaced some of it. The landloard told her she had to throw her furniture again after they had treated it.

Now both of the neighbors were evicted.

Do they have any recourse, to get there furniture replace etc?

Can Landlord do this in unincorporated king county? Tenant

I live in an apartment building and the Landlord has just installed water meters in each unit.  The billing company claims that they can remotely cut power off to the hot water heater for non-payment of the water bill, or for non-payment of rent.  Is this legal?

Shared Parking Mary NY Renter

I share parking with 3 family in the building where I live.  Part of the rental agreement is that we have shared parking. for the last 6 months I haven’t been able to share the parking lot because the tenant living downstairs has a disabled car.  I talk to the landlord about it but there is a different story every time.  I send him a certified letter last month and the other tenant has not moved the car. My question is can in ask that the landlord reduce my rent because I am not able to park my car.
