I am renting a house in New Hampshire The first year I had a signed lease with the landlord the second year she left for florida with out me signing a lease see said the lease I had the previous year would carry over to this year. (I know that is not true state laws says that if there is no signed lease agreement it goes to month to month) This third year starting Jan 1 there is still no signed lease she typed up what she calls an addendum to last years (again last year no signed lease) lease saying that My rent will increase by $50 a month for the first six months and another $50 after another six months she is requiring me to get an electric fence for my dogs. My question is what lease would the addendum extend from? specially if there was no signed lease from the prior year. Also do I have the rights to put in the lease that landlord is not allowed to use my tools or equipment without prior notice and permision from the tenant? (she will take my rototiller, wheel barrow, gardening tools ect and use them without asking first nor pay me for the gass she burns in my equipment and sometimes not even return them back to me I have to go get them yet she charges me for when her husband plows my drive way without asking then tell me I have to pay him because he used gas to plow even though I was suppose to find my own person to plow they never gave me a chance now I have to pay them). Anything will help. |

In the past month I have been without a dishwasher for 2 weeks, had no hot water for 4 days and now they have replaced my tub and bathroom tile without telling me, but it’s not grouted or sealed so I cannot take a shower. Communication from the property management is poor or non existent. My questions is this–Can I legally withhold part of my next rent payment for the lack of services I have experienced? If so, how is this figured? |

My family and I moved into a house in July. About 6 weeks after moving in, we began receiving mail from the homeowners association regarding overdue fees and a lein being placed on the property. After further investigation, we discovered that less than two weeks after signing the lease, the property was foreclosed on. We discovered this in October. I contacted the attorney for the bank and was told we have 90 days protection under the tenant protection foreclosure act of 2009. Again, I began researching and discovered that we should be able to continue residing here until the end of our lease. However, the bank has demanded that we vacate the premises within 3 days. Yes, that would be Christmas day. I spoke to our clerk of courts and was informed that no eviction has been filed. Is anyone familiar with the protection act and can you tell me what our rights are. |

| Can repeated cockroach problems void a lease? | Tenant | ||

My relative signed a one year lease on an apartment, and became unable to continue living here so we worked it out with the property agency that I would move in and assume the lease. While my relative was here I found a cockroach and the landlords had the apartment sprayed. Before I moved in, I was assured that the roaches were taken care of. Wrong! They just sprayed again (the 2nd time in around 3 months). They only sprayed 5/10 of the units, so I am figuring the bugs will go to the unsprayed apts and come back when the chemicals wear off. When I called the landlord to tell them about the last roach sighting, the man acted like it was no big deal and calmly notified me that bedbugs have also been a problem here..but he "assured" me that it was nothing to worry about right now because it usually isn’t a problem until the spring and summer. I have asthma and had to stay out for 4 hours plus many more hours for it to air out. The place still smells and there is a filmy residue on everything I was unable to cover, and the smell was also absorbed by everything in cupboards. I am a laid off college student with a limited income and can’t afford to keep washing everything at the laundromat. I would also like to be able to sleep peacefully again instead of worrying about all of this! The lease is co-signed by a 3rd relative, so I do not want to just leave and ruin his credit. Can I legally get out of this lease without ruining anyones credit and get my deposit back because of bugs?? How do I go about doing it? Is there a proper procedure? I am looking for any advice someone can give. I am currently renting a home of which seems I have had nothing but problems since we’ve moved in as far as getting maintenance done in a timely manner but yet have been completly flexible with the property manager. It is a private home that is managed by a real estate agent as the owner is active duty. To start off the 1st day we moved in I was supposed to be able to pick up the keys at 9am on the move in day however got a call stating that the cleaners hadn’t had a chance to come in and clean yet and would I mind waiting for a few hours before I picked up the keys. I said sure no problem, then found out when I got to the house that the refridgerator was never cleaned, cupboards, floors, baseboards, etc. In fact the area on the lower part of the island turned the towel I was using BLACK. I still needed to go through the house and actually clean it prior to moving in our belongings. Then we didn’t have air conditioning of which I called and spoke with the property manager who said I needed to give it a few days to see if the temperature started changing as the system hadn’t been used for a while. Giving them the benefit of the doubt I gave in and said ok as I am new to the area and was hoping they were telling me the truth.. However the air conditioner never did start to work so I called again and in the long run it ended up taking a month to get a NEW air conditioning unit put in to the house. The next problem occured the following month when we had a really bad rain storm and our house started smelling extremely bad like sewer. I called the property management office and was told that was normal for this area when there is a bad storm and if it happened again to call them back as we were not on a Septic system. The next time it happened I called and spoke directly with our property manager who stated that the smell is normal and that after a storm it happens at her house as well and that there was nothing they could do. The next problem was our heater (run through the same unit as the AC that was replaced a month after we moved in) of which didn’t work. A day after that complaint (and living in 55 degree weather in my house while sick and 4 months pregnant) the company who installed the unit came to fix the problem with the heater and left without checking the system prior to leaving. I tried to start the heater however didn’t work again. I called back to the property manager and was told that she would call the company. When she called back later that day I was told that the reason it didn’t work was because the new unit required propane of which we needed to get filled however was never told that when the new unit was put in. (personally I feel that is the job of the property manager to inform us, not ours to chase down answers) In order to get propane I had to call the local company of which couldn’t make any deliveries until the following week!!! Once the heater started going it stopped and the fan continuously ran, cold! I called AGAIN, they contacted the company who installed the unit who came out and had to replace ANOTHER part the FOLLOWING day. The next problem which happened about a month ago, after another rain storm, was the sewer smell coming back and one of our toilets not flushing… I called AGAIN, the owner who was in town came by to take a look and said he would make sure they got a plumber over to the house, 4 days later a plumber showed up. The FINAL straw is after this past weekend, once yet another storm, I looked out the window after letting my dog run in the back yard and saw sewer coming up out of the ground and once AGAIN the smell (am now 6 months pregnant with visitors in my home as my husband is getting ready to deploy!). I immediately called the property management after hours number and did not get a phone call back yesterday (which was Sunday) which I think is disgusting as we have sewer in our back yard and the smell in our house with guests! It was embarrassing and sickening that we had to leave the home and could not entertain my husbands family prior to him leaving for Afghanistan for a year. I called the property manager back the next day (Monday) and was told I was on her list to call. I voiced my frustrations to her and told her we want out of our lease for multiple reasons and are covered under the military clause in the lease. She stated that we still needed to give them 45 days notice or owed our rent through the next month of which I think is ridiculous.. I know I am obligated to pay rent however I am VERY appalled by all of the problems we have had in the 7 1/2 month stay at this house. The property manager then stated that we did not complain about the sewer smell and I told her that was the MAIN reason/complaint for calling the other 3 times! I am just so frustrated and tired of dealing with all of this plus now preparing for my husbands deployment. I don’t feel we should be paying for rent when they aren’t doing their job to fix the problems the first time, it takes MULTIPLE MULTIPLE calls to rude people to get anything fixed! Any advice? |

| Adequate heat in Rental? | Tenant | ||

What is defined as adequate heat? The apartment gets warm over time but I think the apartment is very poorly insulsated with very very old windows. When putting my hand near them, they all feel drafty. Is there anything the Landlord is required to do to with regards to energy efficiency.. otherwise.. my heating bill is going to be enormous. Any help is greatly appreciated. |

I rented this place with just pictures from internet. When i got to this home and opened the door the smell almost nocked me over,then i notice Rat Droping under sink area and draws. In the diningroom was bear wiring hanging out of the wall. the carpet in one of the bedrooms was stained and didn’t reach the walls and there were no baseboards to cover up where carpet didn’t reach. I opened up the door that went out from the dining room into shed,then the door wouldn’t reclose,and in this shop the wire just hang loose. The drains drained so slow that when running the water to clear spider down drain it just set in tub,and the torlet you had to flush twice to get torlet clean. the stove was so dirty no one would want to use it. Then I notice fles on me. The woodburning stove was so full of ashes you couldn’t get anymore in it. The kitchen cubburts had no top on them to keeps bugs or what ever out,and from looking on top of the refiguature you knew there were lots of bugs. I took lot of pictures. Anyway i called her the next day of seeing the place that I couldn’t except the place. She said I signed an month to month and I was l would have to take tha place for the ist month. Then i ask for my deposit back because I didn’t move in. She says that she has 31days to give my deposit after the 30 days, thats Oregon law. I belive the home was not liveable,so should she get away with this? What are my options? |

I am on my second lease with my current apartment community. I was offered a referral bonus of $250 if I recommended a new resident. I did this in September of this year and was told I would receive the check for the referral after the new resident paid the first month rent. That was paid in October by the resident. I called several times to follow up and after being told a series of lies about the paperwork being completed, I was assured it was completed and sent overnight to the corporate office on the 20th of October. I still have not received my referral check and after several calls, no response. I was told just last week that when the corporate office goes to cut the check, they look at the ledger for both residents (referring and referred) and if there is not a zero balance on BOTH, they do not issue the referral check. This was NEVER told to me when I used the referral benefit and they cant tell me how often they check. I feel I am owed this money, two fold and I am held helpless because of conditions being made on the spot. What can I do? |
