Me and my husband rented an apartment in July of this year, we have 8 months left on our lease. Our rent is 617.00 a month, If rent is late there is a $50.00 fine and an $85.00 fine, we also pay 55.00 a month for water sewer and trash.  Our rent was 3 days late and we ended up paying $1.085.00 , we paid it because we did not want to be evicted due to us being out of state at the moment.  Since day 1 our neighbors upstairs are so loud i cant hear myself think most times, i have complained to the office 9 times, and once after that, all documented. I have also had to call the police on them, the noise is always from about 8pm to 7 am.  We live in a crime free housing complex, She has overdosed on prescription pills, my neighbor had to drag her out of the apartment unconcious and call 911.  My husband works out of state about 3 weeks out of the month, she has two guys that ive been told by the management arent alllowed to be there, I am 7 months pregnant, so in no way do i want to start any problems because they make me feel extremely unsafe.  I had to leave my apartment at midnight the other night to go stay with my husband out of state (it was a 14 hour drive) because they were being so loud, i ended up being lifeflighted from a canyon because i went into premature labor, when i was put into labor and delivery they said my stress level was through the roof and that it had caused my complications.    I want out of our lease, I cannot bring my baby home there, i cant even be there. I know they do drugs, but i wont use that as a factor since i have no way to prove this.  I just want out of my lease, I dont care how to get out of it, i work in the medical field, so my law knowledge is not very good at all.  Does anyone have any advice???

I’m currently renting a property that has been in foreclosure since I moved in. We are renting through a Property Management company.  We have lived in the house since 08/2010.

The rent is not what I consider "cheap" at $ 1,700.00 per month. Two issues to this point, when we moved in the grass was dead which was duly noted on the move in inspection sheet and that was turned in timely to the Property Management company. They try to get us to replace the lawn (and went as far to admit that they are on the hook according to the owner because the lawn died in between the prior renters and us moving in, so the owner feels that the onus is on the Property Management company). Secondly, the overhead microwave broke and the repair man they sent out confirms that there is no fixing it that is needed to be replaced (this also means the exhaust fan doesn’t work). The owner did not want to replace the microwave and offered a counter top and then didn’t even come through with that.

Now they want me to sign a new lease (only giving 12 days notice to decide) or the rent will go up $ 100.00 per month.

My issue is that my elderly sick mother lives with me and I do not have the necessary monies needed to move.

Questions -

1. This property management company does not exactly strike me as ethical. I am worried about my security deposit. Any recourse here?

2. Is it acceptable to only provide 12 days notice re: a re-sign or rent increase?

3. At what point should the bank be getting the money?

4. Given what I have outlined, would it do any good to file a complaint with the DBPR?

Upon moving into this apartment my roommates and I did not notice (and were not informed by the rental agent) that the only rooms with updated electric sockets were the kitchen and the bathroom. Every other room has single socket with no grounds and the plug-ins are loose fit. We have had three times the normal light bulbs blowing out and we have had a two-three prong converter actually melt from a surge. Of course it doesn’t help that in order to remain plugged in place some sockets actually have duct tape keeping the plug from just dropping out onto the floor.

Approaching the landlord’s workman/manager upon rent collection we were notified that this problem was known and was not do to be fixed for a year or more. We also broached this subject with the landlord who then also gave us the same answer, he cited work on another rental property that was currently in the works (which is now finished).

He complains about us falling behind on rent but doesn’t see fit to deal with the problems we have to deal with because of his ignorance of them. I deal with higher utility bills on top of replacing light-bulbs and living with the fear of bad surges even with surge protectors since there are no rated plug-ins for them.

We also had problems with our heating unit shutting off during the winter, someone came in, checked, told us that if this continued to inform the landlord and the cleaning and maintenance would be done. We are now four months since that problem, we had reported it twice and the only reply was it will be taken care of during ’scheduled maintenance’.

Does anyone know if a rental renewal letter is a legal binding document?  My lease expired on 1/29/12.  The property management company sent me a renwal letter back in November 2011.  I check the box on the renewal letter indicating that I would like to renew.  The letter stated that they would draw up a new lease, have me sign it and return it to them.  I went over to the management company 3 times during January to sign the new lease and they indicated that it was not ready.  On the 3rd visit they said it was still not ready but that they would send it over to my apartment for me.

It is now May and I have purchased a home and have sent a letter in giving 60 days notice.  The property management company is saying that I owe them the $1,275 cancelation fee from the original lease because the rental renewal document was my "new lease".  Is this legal?

Do I have the right to be present at the time of move-out inspection?

I live in Portland maine and rent a studio. I have lived here for almost 2 years and for the past 2 and a half months I have been being bitten by bed bugs every night. I was never told that the other tenats had them or had been being sprayed down for thwm until i mentioned the bugs to my lanlord. I guess this building has had it for a year. he told me to get a plastic sheet and that would solve it. he aslo said someone would spay it and he hasent followed through. all the neighbors have told me that they are going through the same thing what should I do?

I was robbed 1 time, (my door was  kicked in )  and 2 attempted robberies  and my car vandalized in the parking lot.  I informed Middlesex management that I would not be renewing my lease ( I gave them a 3 month notice)  and when my lease was up I moved, this was April 30, 2012.   I have attempted numerous times to return the key.  No one was ever there and when I told them I would mail them , I was informed that I couldn’t because there were papers I had to sign.  Everytime I called to make arrangements to drop off the key, a Middlesex management eMPLOYEE WOULD GIVE ME DIFFERENT INSTRUCTIONS

 Today I received a phone call informing me that since they did not receive the key they are charging me a months rent ($901.00) They have yet to return my security deposit.   They claim they can not get into the apartment, which is not true, they have copies of the key. Yet, they knew my lease was up and I moved out,  leaving them all my information, including my e-mail they did not contact me until today which is 15 days after I moved out.  It doesn’t seem to matter how many times I went to their office to turn in the keys and they were closed. 

I haven’t actually lived there for months, the last robbery attempted was February 2012 and I left that night.  I paid the rent(on time) every month until the lease ran out.  I think they are trying to keep my security desposit.  Why should I pay a months rent when I left officially in the proper manner, and they were closed when returning the key?  Is this legal.  They have copies of all the keys, they could have just brought a new lock.  They would have to change it anyway.  Please advise ASAP.  Thank you for your help

I have been renting my place for almost 3 years. When I first moved in it was just me, my fiance and 2 kids. When I first moved in I told the landlord that I only have enough for the security deposit and first months rent and then I will not have the whole months rent at the beggining of the month so if it would be ok I can give him half at the biggining of the month and the other half before the month is over, he agreed, well I’ve been paying like that ever since.  Once in a while I get a harrassing letter from the landlord wife saying she doesnt like how we pay rent, which i agree is due at the beggining, but i dont have the whole thing at the beggining of the month… I have never missed a payment, I am not at all backed up on my rent, I do not cause any problems, besides the way I pay my rent I think im a good tenant.  I never call her for anything because she’s a very nasyt person, no people skills at all (the husband is very nice) but she does not know how to talk to people. Unfortunately we had no hot water for 3 days so I had no choice but to call her, I called her and said we dont have hot water, she goes OK Ill send someone but first I need to ask you a few questions, I said OK.  She says how many kids do you have living in your apartment? I said well 3 now because I just had a baby a month ago, she goes "you cant live there with 3 kids its too crowded (we have 2 bedrooms), Im like well she’s a newborn so she doesnt take up alot of room, she goes "when are you moving out?" I said when Im able to move out I will let you kno, she sighs and says "I hope its soon, you can barely pay your rent" so I asked her "do I owe you anything?" she says "NO" then she goes "I dont like how you’re paying rent and I can take you to court"  so I said by all means please do". The next day we’ve received a letter from her saying she is raising our rent ($35).  I dont know what this lady’s problem is with us but besides the way we’re paying rent we’ve been pretty good tenants.  Im getting tired of this lady making me feel like I cant call her if something needs to be fixed (which is alot) because she’s going to put me down and tell me she wants me to move already.  Unfortunately I am struggling (like millions of other people) but my rent gets paid.  I dont need this lady to put me down all the time.  Is there somewhere I can report her for harrassing me? Do I have any rights??
