Landlord kept $300 for painting???

TX Renter Q & A

We’ve recently bought our 1st house and moved out of our rental.  The landlord kept $300 for painting and labor in a place that we lived in for 14 mos.  We did spackle the holes and attempted to paint over the holes.  None of the paint she had in storage would match (though she said she had some).  It was flat paint so it could not be wiped down w/o removing the paint from the walls.  We finally talked to a paint store who told us it doesn’t matter if we found the right color or type of paint because when it dried, new paint will always dry differently than old paint.  Now there’s a complaint that there are large brush strokes instead of small ones and she had to repaint the whole place which she didn’t feel she should have to do after 14 mos. of living there.  There were 2 adults, a teenager, a 10 year old and a dog occupying the premises.  All were on the lease.  Can she do this and if so, isn’t $300 rather excessive?
