I’ve been living in a loft apartment for about 8 months now on a 1 year lease, I had a problem with a leak about 4 months ago.  I called management and they said they would get maintenance out here as soon as they could, it took almost a week and they finally showed up to address the problem. I live on the top floor and have an angled ceiling, the leak was located at the bottom of the angled ceiling where it goes back up at a 90 degree angle where theres a nook and a ceiling fan.  When they finally got out all the roofers said they found the problem and patched the roof, and all that was done on the inside for the water damage was slap on a little new plaster and paint.  Fast forward 4 months, we just had a pretty nice storm to kick off the fall season, and the leak started again this time not in the corner but about five feet down from the corner of the wall where the initial repair had stopped, where the paint was cracked & continued the length of the overhang, I was worried about mold seeing that all that was done in the first place was basically just cosmetic.  You could see before that there had been water damage before, the wall was stained and the paint puffy and cracked.  What are my options as far as breaking this lease if need be, my girlfriend lives with me and has a SVT, a heart condition where the heart starts beating rapidly.  As far as the mold, if there is any how can I go about finding if there is, should I hire a contractor or is that something I should have the apartment do seeing as they are in charge of repairs and especially the roof?  Any help would be appreciated.

Your landlord needs to take care of your leaking roof. There are options where you can pay for it and then deduct it from your rent, but that would require that you go through some type of legal process. (maybe a complaint with RPA??) As far as breaking your lease due to a leaking roof… might be a stretch. If the leak is causing discolor and cosmetic issues it probably isn’t enough to claim a breach of contact which would allow you to terminate your lease.

You do have right to demand that they repair the roof. They might be dragging their feet because it could be that the entire roof needs to be replaced which would cost a lot of money. (easily 10 thousand dollars)
