water bill issue with landlord

WA Legal Questions, Renter Q & A

My post below showed I lived in WA not OH.  It wouldn’t let me edit it.  so I am reposting.  We get an invoice from our landlord for water.  They tend to not send us the bill often and cause us to fall behind paying them water.  They say they are not worried about it since it is their fault.  On the other hand I found out that they haven’t paid the water since sept themselves and we paid for every month except dec since we didn’t receive an invoice.  This is the 2nd time this happened.  Is this considered a breach of contract?  Should I start sending our rent and water bill money to escrow?  Can I leave and go to a new company and still get my security deposit back?

Hi Heather, i think you need to sit down and talk again with your landlord about them not paying the water bill. This is isn’t your fault. Your LL should have paid those since you’ve been paying them as well. I’m not sure what’s written in your lease but i think this is a breach of you contract. However it’s still best to look it up in your lease. Should you need further assistance with it. You file a complaint with RPA. Hope this helps.
