COMPLAINT DETAILS (from renter)

In early June a storm knocked a tree into the house causing severe damage to the building. The landlord had the tree removed from the roof on the next day. However, no repairs have been made to the building. Renter has been witholding rent (Rent Abatement) until the building is repaired and rendered safe. Renter waould like the landlord to repair the house immediately. Renter is concerned with the property being left in this condition.

Agent Aug 27, 2008 LANDLORD FOLOW-UP: Landlord has agreed to drop the court case once he receives the rent payment. He has also agreed to charge the renter $400 per month until the repairs are made. Landlord will not be evicting the tenant as long as these conditions are met.

Agent Aug 26, 2008 LANDLORD ACCEPTANCE: Agent notified the landlord of the terms. The landlord is willing to drop the court case, however he would need the rent money by Friday. As for setting a move-out date the landlord will need to discuss this with his partner. Agent suggested that he reconsider the possibility of keeping the renter. Landlord said he would respond tomorrow morning.

Agent Aug 26, 2008 RENTER AGREEMENT: Renter understands and is willing to do whatever it takes to resolve the situation. Renter is willing to pay the $1200 in back rent by Friday and set a move-out date for Oct 1st, or earlier if needed.

Agent Aug 26, 2008 LANDLORD AGREEMENT: Afer speaking with the landlord he stated that he would consider dropping the court case if the renter would agree to pay his back rent at the discounted $400 per month. In order to accept these terms the renter would also need to agree to a move-out date.

Agent Aug 26, 2008 LANDLORD CONTACTED: Agent had a long conversation with the landlord. Landlord claims the damage was done to an enclosed porch and poses no problem for the rest of the home. Landlord explained that he wanted the renter gone. The construction workers are not willing to work on the unit because of the dogs living within.
