Fair Resolution according to renter :
  1. A fair resolution would be for my landlord to rightfully return my portion of the security deposit.

COMPLAINT DETAILS (from renter)

Security deposit paid to landlord. Landlord agreed to release me of all lease obligations and have another tenant take over agreement. I have contacted landlord to have my deposit returned and landlord advised it is my responsibility to retrieve deposit back from current tenants. Tried to negotiate with landlord to come to a mutual agreement and she again advised to call current tenants to make arrangements. Landlord unwilling to work with me to resolve this issue.

Renter Feb 5, 2009 12.118.66.202 Landlord did not do a sub-lease. Landlord had a written agreement signed by me and new tenant that he will be taking over the lease and I will not be held to orginal lease. Landlord also removed me from original lease and replaced my information with new tenant.

Renter Feb 5, 2009 12.118.66.202 I made attempts to respond but for some reason it is not working. Currently my past landlord Edna Nuvall is attempting to get bank approval to do a short sale. Its obvious the client does either have the money to refund and I do not trust she will return at end of lease. I do not feel I should be held liable for security (damages) as I do not reside in this house. It should be the landlords responsibility to collect deposit from current tenants.

Agent Jan 27, 2009 MEDIATION AGREEMENT: Landlord has agreed that the deposit will be refunded as agreed upon with written contract: At the end of his lease term. Landlord has also agreed that if Brandon gets a deposit from his subleasee, the landlord will be willing to refund Brandons current deposit to his subleasee. Therefore, not requiring Brandon to worry about refunding the deposit back to his subleasee.

Agent Jan 27, 2009 TENANTS RIGHT: Tenant has the right to negotiate deposits with his subleasee. Acting as a Subleasor (Brandon Taba) has right to request a security deposit from his subleasee. By doing so, Brandon will be held to landlord laws governing the refund of the deposit. Meaning that at the end of the sublease contract Brandon will refund the deposit to his subleasee.

Agent Jan 27, 2009 DEPOSIT ENTITLEMENT: Landlord will promptly return the deposit at the end of the lease term. However, the security deposit is contractually protected through the end of the lease term. Landlord is not willing to refund deposit prior to the end of term as it will leave her with no security.
