COMPLAINT : Breach of Agreement
Fair Resolution according to renter :
  1. We asked to have the house re-listed as "For Rent" and to refund us at least half (1050.00) of our deposit back.

COMPLAINT DETAILS (from renter)

Upon move in on December 29, 2009, there were issues with the house that were supposed to be fixed prior to that date. The carpet was not laid, a door not installed, the house had and still has not been cleaned, there are windows with duct tape that were "going to be replaced", a dead mouse found floating in the toilet, a bag of garbage left in the kitchen, piles of sheets and pillows from the previous tenants, an outlet in the living room is hanging 4 inches out of the wall, etc. We have photographs and video of the condition of the house. It was agreed that before we were given the keys on December 29th that these things were going to be fixed. He has now told us that we can take care of them ourselves and he will pay us by the hour to clean the house (which is full of dead bugs, dead mice, etc). The day we signed the lease was the same day we asked him to reconsider if these things were not going to be addressed, where he told us that we were being immature and that we couldn't have anything back now. We asked him on Dec 29, 2009 to re-list the house as "For rent" and we put it in writing like he requested, but we were hung up on and he did not answer our calls for 5 days. I had no way of delivering the written request. We should not be penalized because he has not yet re-listed the house. He is in no hurry to help us all out of this bad situation. My other family renting with us were forced to find another place to live as their lease expires on January 10, 2010.
