COMPLAINT : Failure ot landlord to provide water as required by lease
Fair Resolution according to renter :
  1. I have given written notice of moving 3/1/10, landlord is telling me I have to move at midnight, asking personal questions, why do I need a moving van, and without inspection refusal to return deposit, she is angry about the call to her re.no water

COMPLAINT DETAILS (from renter)

Landlord is angry regarding the call I made to her when the building was without water, I asked for a water hose to be attached to another building so I could have water for hygiene, they had told me I would be without water for 1.0 hour on Saturday, I was not given notice water would not be restored until the following Monday, she has already stated I will have to move during the night, as her cleaning crew would appear at midnight, also told me there were damages to the apartment of which she has never made an inspection, I have cleaned apartment thoroughly, including steam cleaning carpet on 3 occasions as it was so filthy, as was the entire apartment, my notice was given 30 days in advance indicating I would vacate same 3/1/10, now she says move out during the night 2/28/10, it is vindicative when I called her about the lack of water for hygenic grudges, and refuses. The apartment was misrepresented, as there were items in non working order, which I have repaired as the manager on site is ill and resigned, she is threatening eviction for approximately 10 hours, as she states she never saw the written notice, as mentioned earlier, manager on site Skip has been taken ill and retired 2/16/10 and there is no replacement to date.

Agent Mar 31, 2010 NO FURTHER RESPONSE: Agent has not received any further response to this case. Due to the lack of response, it is assumed this case is resolved. Agent has provided a reasonable time frame for additional responses. Due to inactivity the agent has no choice but to close this case as resolved.

Agent Mar 9, 2010 FINAL 3 DAY RESPONSE: Agent is providing both parties with 3 business days to create a final statement or response. Following the 3 day period this case will be closed. Agent was not able to find any serious violations.

Agent Mar 9, 2010 LANDLORD FINAL: Landlord was very cooperative and was hurt that the tenant filed a complaint. She is committed to keeping tenants happy and feels bad the tenant had to go to this point. Despite the complaint the landlord feels that she has been fair and apologizes to the tenant if they feel they were treated with anything but great service and respect.

Agent Mar 9, 2010 DEPOSIT: According to the landlord the tenant did not provide a deposit. However, all rental agreements state that the tenant is responsible for a $200 non-refundable cleaning deposit to cover general cleaning and shampoo. Tenant has and will not be charged for this fee even though the contract demands it. Landlord is trying to be fair with tenant.

Agent Mar 9, 2010 PERSONAL QUESTIONS: Regarding personal question about moving van. Landlord was surprised that the tenant needed a van since the properties are fully furnished from furniture to towels. Landlord asked the question because the tenant was requesting a later move date than what was agreed upon. Question seems logical and not in violation of any privacy law.

Agent Mar 9, 2010 WATER PROBLEM: Landlord has explained that the water problem was due to a plumbing emergency that occurred on Super Bowl Sunday. Management could not find a plumber to come until Monday. Notice was given that the water would be temporarily unavailable until fixed. Management rushed the process as quickly as possible and even provided buckets of water so that tenants could still flush toilets. Repair time-frame seems reasonable.
