COMPLAINT : Breach of Agreement, several threats of eviction, etc.
Fair Resolution according to renter :
  1. That landord provide record of bank location of deposit funds in his possession. That he pay his HOA fees so I can resume use of amenities and guest registration (have been requesting this since July 2009), written lease agreement.

COMPLAINT DETAILS (from renter)

-In 4 years, landlord never provided escrow and deposit bank info. -Last year a new verbal lease was agreed upon on a month to month basis for 1400.00. -At first year signing (2006) landlord received 3800.00 (1900.00 last month, 1900.00 deposit) -Landord states 1900.00 previously left (2006) as deposit was applied as one month last year and stated that the remaining 1900 left would go toward my last month. I objected stating that he needed to refund 500 so that last month's rent amount be equal to all other months (1400). Under current lease, rent has never been paid late. Landlord promised to bring HOA fees up to date, never did. I withheld 500.00 from April rent so that last month rent deposit would be equal to one month's rent. He is adamant that the money he has is not "escrow or deposit" but last months rent. He cashed this check for 900.00 on April 5th and since then has sent me emails threatening eviction if I don't send him 500 by fedex to be recieved by him tomorrow, I must leave by May 7th. I have tried via email to negotiate this with him and provide him with options, but he continues to threaten. The property has several liens on it since last year and I had been concerned that I would have to move and not get any deposits back if the banks foreclosed or if the HOA asked me to leave due to non compliance of rules about a written lease + late HOA dues. He has threatened in writing via email that he will be at my doorstep with police on the late evening of May 7th. I believe I am being more than fair in waiting for him or his real estate agent to provide me with escrow and deposit account information for over 3 years now as well as waiting for him to pay his HOA fees and provide a lease in writing so that I am in compliance with the HOA. I have reason to believe he is having financial problems, I know that he has taken out loans on the house which are coming due this September, I also know that there are liens on the property. I have no problem continuing to pay him on a month by month basis, provided that he acknowledge that the final month rent deposit he has should match the regular monthly payments, that he provide a written lease agreement, that he provide me with the bank account information where he is holding my funds. I am worried that I will have to leave due to his actions and will never recover the funds (now 2800.00 including the 900.00 check he just cashed) on top of incurring moving costs I can not afford.
